139 <br /> <br /> Mr. John Dezio, attorney for a Shull's Towing Company, asked that his client be <br />allowed to speak. <br /> <br /> Mr. Gouldman said that Shull's Towing Company has taken the position that the City <br />accepted her bid, but the City does not agree. <br /> <br />Ms. Slaughter seconded Mr. Toscano's motion. <br /> <br /> Mr. Toscano noted that the resolution only authorizes the towing advisory board and <br />that no contract would be formally approved until September. Mr. Toscano said he feels <br />concerns raised could be addressed by the City Attorney, and that customer service <br />requirements could be part of the contract. <br /> <br /> Mr. Cox said that it seems that by agreeing to the advisory committee Council would <br />be agreeing to the rotation system, and he would like Council to discuss the rotation system <br />further. <br /> <br /> The motion to approve the establishment of an advisory board failed by the following <br />vote. Ayes: Ms. Slaughter and Mr. Toscano. Noes: Mr. Cox and Ms. Richards. <br /> <br /> Ms. Richards said the rotation system appears contrary to the city's policy for <br />competitive bids, and she would prefer to stay with the competitive bid process. <br /> <br /> Mr. Cox said he feels it would be appropriate to have a public hearing that addresses <br />the rotation system. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Gouldman said that if the matter is <br />delayed or not approved, a contract extension with the existing contractor will be needed. <br /> <br />Councilors agreed to allow public comment at the end of the meeting. <br /> <br />ORDINANCE: REZONING CITY LOT NORTH OF ELSOM ST. FROM R-2 TO B-1 <br />ORDINANCE: APPROVING SALES CONTRACT FOR ELSOM ST. LOT (2nd reading) <br /> <br /> Mr. Satyendra Huja, Director of Community Development, said that the Planning <br />Commission recommended denial of the rezoning because the use would not be in harmony <br />with the Land Use Plan and it would remove open space from the neighborhood. <br /> <br /> Mr. Cox noted that Council had received a petition opposing the rezoning signed by 36 <br />residents of the neighborhood. <br /> <br /> Mr. Toscano said that he will oppose the rezoning, but said that he hopes that the <br />applicant understands the issue since he acted in good faith in proposing the rezoning. Mr. <br />Toscano noted that when the proposal to purchase and rezone the property came before <br />Council, negotiations were entered into by Council because of the need for additional parking <br />in the area, with the stipulation that a public rezoning process was required. Mr. Toscano <br />said he agrees with the Planning Commission's denial on the basis of the proposal being <br />inconsistent with the Land Use Plan and the impact on the neighborhood. Mr. Toscano said <br />the City will need to continue to explore ways to provide additional parking in the area. <br /> <br /> Mr. Cox said he feels the property should remain a park, and recommended that there <br />be a community service competition through the School of Architecture to find ways to <br />increase usage of the park. <br /> Ms. Richards said she is persuaded to den), the rezoning because of the need to <br />preserve green space in the neighborhood.
