146 <br /> <br /> 8. This permit may be revoked by City Council at any time after a hearing conducted at <br />any regular meeting, provided the operator has been notified of the hearing by written notice <br />delivered to its place of business at least ten days before such meeting, if the Council finds: <br />(a) that the operator is violating the terms of the permit; (b) is delinquent in paying rent; (c) <br />that the continued operation of the cafe poses a threat to the public health, safety or welfare <br />or constitutes a public nuisance; or (d) if by June 1st in any calendar year covered by this <br />permit, the outdoor cafe has not been in substantial operation for a period of 60 days, or if <br />the cafe ceases operation for a period of 30 days or more prior to Labor Day' of any year. <br /> <br /> 9. This permit may be revoked at any time upon six months' notice to the operator, for <br />any public purpose as determined by the City Council. <br /> <br /> 10. Approval of this permit is conditioned upon the applicant's compliance with the <br />plans approved by the Board of Architectural Review. <br /> <br />11. ORDINANCE: Repeal of Bingo/Raffle Ordinance (carded over) <br /> <br />PUBLIC HEARING: FAIR HOUSING PLAN <br />RESOLUTION <br /> <br /> Mr. Satyendra Huja,.Director of Community Development, explained that the Fair <br />Housing Plan was developed by the Thomas Jefferson Planning District Commission and City <br />staff, and identifies impediments to fair housing and makes suggestions with how to remove <br />the impediments. <br /> Mr. Cox asked what public means are available for filing complaints, noting that only <br />three complaints are listed as having been filed. <br /> <br /> Mr. Huja replied that the Fair Housing Plan emphasizes education to inform people <br />about their rights. <br /> <br /> Mr. Cox expressed surprise that a fair housing/cMl tights commission was not <br />identified as an option in the plan. <br /> <br /> Mr. Huja said that existing fair housing/civil rights commissions use general funds and <br />have substantial budgets, and it was felt that the community' should first use what is available. <br /> <br />Ms. Daugherty noted that the Legal Aid Society is used for fair housing complaints. <br /> <br /> Mr. Cox said he feels fair housing problems could be resolved by aggressive <br />enforcement and by the formation of a Fair Housing Commission and rental occupancy <br />program, neither of which the plan recommends, <br /> <br /> Mr. Huja said it is his understanding that the Fair Housing Commission and rental <br />occupancy program will be discussed at Council's retreat. <br /> <br /> Mr. O'Connell said that reports are being prepared by staff for the retreat on a Fair <br />Housing/human tights commission and a rental occupancy program. <br /> <br /> Ms. Richards noted that the Thomas Jefferson Planning District Commission will be <br />holding a public heating on the Fair Housing Plan and she encouraged Mr. Cox to comment <br />at that time. <br /> <br /> Mr. Toscano suggested that the major reasons why whites are denied mortgages be <br />listed in the plan. Mr. Toscano said he hopes that the Planning District Commission will <br />continue to push for an increase in affordable rental housing in 33bemade County. <br /> <br /> <br />
