218 <br /> <br />RESOLUTION: AUTHORIZING SALE OF CSX PROPERTY <br /> <br /> Mr. Jim Gahres, Director of Economic Development, said that on November 12, the <br />Charlottesville Industrial Development Authority approved a contract to sell a portion of the <br />CSX property to Oliver Kuttner for $28,000. The purchaser has requested that the zoning be <br />reduced from M-2 to M-l, and certain uses have been restricted in the contract. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, Council unanimously <br />approved the sale of the CSX property to Oliver Kuttner. <br /> <br /> WItEREAS, on November 12, 1996, the Charlottesville Industrial Development <br />Authority (CIDA) approved the sale of Parcel A-2-3 of the CSX property to Oliver Kuttner <br />for development of residential, office and commercial space, subject to certain design <br />controls and reviews; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the <br />Land Purchase and Development Agreement, in substantially the same form as attached <br />hereto, between the CIDA and Oliver Kuttner, dated November 5, 1996, is hereby approved. <br /> <br />RESOLUTION: SPECIAL PERMIT FOR PRIDE OF VIRGINIA LODGE - 305 9TH <br />STREET, N.W. <br /> <br />Mr. Cox abstained from participation in the special permit due to a conflict of interest. <br /> <br /> Mr. Huja explained that the Planning Commission recommended approval of the special <br />permit to allow for the Pride of Virginia Lodge to operate as a private recreational facility for <br />group use for the following reasons: 1) It would permit the rehabilitation of a deteriorated <br />residence in a manner that permits its future use as a residence; 2) It would benefit the health, <br />safety and welfare of the adjacent neighborhood; 3) The proposed use would not have a <br />significant adverse impact on the neighborhood if conditions are met; and 4) It ,Mll permit <br />the provision of recreational services for the youth of the neighborhood. <br /> <br /> Responding to a question from Ms. Daugherty, Mr. Huja said that parking spaces will <br />be required by the site plan, but noted that most users of the facility live in the adjacent <br />neighborhood. <br /> <br /> Ms. Daugherty asked if use by the facility by outside groups will be supervised. Mr. <br />Huja said that no outside groups are proposed to use the facility, but that could be made a <br />condition of the special permit. <br /> <br /> Ms. Richards said that use of the outside basketball courts will be hard to supervise. <br />Ms. Richards said the house has been in bad condition and unused for many years and this <br />use will provide a good community benefit. <br /> <br /> Ms. Slaughter said she would support a requirement that the use of the facility be <br />supervised. <br /> <br /> On motion by Ms. Daugherty, seconded by Ms. Richards, the special permit was <br />amended to include that the facility be supervised, with Mr. Cox abstaining. <br /> <br /> The special permit for the Pride of Virginia Lodge was approved by the following vote. <br />Ayes: Ms. Daugherty, Ms. Richards, Ms. Slaughter. Noes: Mr. Toscano. Abstaining: Mr. <br />Cox. <br /> <br /> WHEREAS, The Pride of Virginia Lodge #122, contract purchaser of the property at <br />309 9th Street, N.W., has requested a special use permit to use the house and property as a <br />private non-commercial recreational facility for group use. This property is further idenfffied <br />as Parcel 228 on City Real Property Tax Map 31, having approximately 100 feet of frontage <br />on 9th Street, N.W., and containing approximately 7,994 square feet of land or. 18 acres; <br /> <br /> <br />
