86 <br /> <br />The approved site plan, including landscaping and <br />trees to be added along BirdwoOd Road, must be <br />completed; <br /> <br />A flashing school zone sign shall be installed in the <br />east bound lane of the Route 250 Bypass; and <br /> <br />The Planning Commission shall receive a copy of <br />Covenant School,s report on compliance with the' <br />Americans with Disabilities Act. <br /> <br /> BE IT FURTHER RESOLVED that the Covenant School is <br />encouraged to make every effort to met its stated goals of 15% <br />minority representative in the student body, on the faculty <br />and on their board. <br /> <br />RESOLUTION: AMENDING SPECIAL PERMIT FOR MACAA COMMUNITY EDUCATION <br />CENTER AT 1027 PARK STREET <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br />that the amended special p~rmit to allow the closing of the <br />250 Bypass access to ~he 'proposed ~CAA Co~unity EducatiOn <br />Center for a one-year period to allow for observance of the <br />impact on Park Street access be approved. <br /> <br /> On motion by Ms. Daugherty, seconded by Ms. Slaughter, <br />the resolution amending the special permit for MACAA Community <br />Education Center was unanimously approved by Council. <br /> <br /> WHEREAS, the Monticello Area Community Action Agency <br />(MACAA), owner of the property at 1025 Park Street, has <br />requested an amendment to the special use permit granted by <br />City Council on January 4, 1993 (copy attached), in order to <br />eliminate access from said property onto the Route 250 Bypass <br />and make traffic control improvements at the Park Street <br />entrance; this property being further identified as Parcel 2 <br />on City Real Property Tax Map 45, having approximately 70 feet <br />of frontage on Park Street, 626 feet of frontage on the 250 <br />Bypass, and containing approximately 343,557 square feet of <br />land or 7.89 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on June 8, 1993, this Council finds that such use will conform <br />to the criteria applicabl~e to special permits generally under <br />Chapter 34 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special use permit granted <br />on January 4, 1993, for the Community Education Center of <br />M~CAA is~ for a one year trial period, amended to eliminate <br />the following requirements: (a) that there be access from <br />said property onto the Route 250 Bypass, and (b) that the <br />entrance at Park Street be chained off. Said trial period <br />shall begin running on the date this amended special use <br />permit is approved by Council and end one year thereafter. <br /> <br /> The approval of this amendment to the special use permit <br />is conditioned upon the following: <br /> <br />Phase I of the site plan shall be completed within <br />one year of the approval of this amendment to the <br />special use permit; and <br /> <br />Phase I of the site plan shall include installation <br />and reactivation of the flashing warning sign on <br />Park Street at MACAA's expense, and modifications to <br />the Park Street entrance for two-way uniform width <br />and improved turning radius; and <br /> <br /> At or near the end of trial period, if MACAA wishes to <br />eliminate the 250 access and Park Street chaining requirements <br />on a permanent basis, MACAA shall seek another amendment to <br /> <br /> <br />
