36 <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br />approval of the special permit for higher density for the <br />following reasons: 1) It is in harmony with the Land Use <br />Plan of the Comprehensive Plan; 2) It will not have a <br />significant adverse impact on the surrounding area over that <br />which is allowed by-right; 3) It will result in a reduction <br />in the number of bedrooms in the complex; and 4) It will <br />avoid excessive alteration to the existing.1895 house. <br /> <br /> On motion by Ms. Waters, seconded by Mr. Toscano, the <br />resolution granting a special permit for higher density at <br />108 Clark Court was unanimously approved. <br /> <br /> WHEREAS, Robert and Ivy Weitzner, owners of property <br />known as 108 Clark Court, have requested a special use permit <br />to increase the density of the apartments under construction <br />from 12 total dwelling units to 14 total dwelling units; this <br />property being further identified on City Real Property Tax <br />Map ~17 as parcels 91 and 91.6 (combined), having <br />approximately 56 feet of frontage on clarke Court, and <br />containing approximately 25,965 square feet of land, or .60 <br />acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on November 12, 1991, this Council finds that such use. will <br />conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code, and the <br />standards for higher density set forth in Code section <br />34-201; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a special use permit is hereby <br />granted to Robert and Ivy Weitzner to increase the density of <br />the apartments under construction at 108 Clark Court from 12 <br />total dwelling units to 14 total dwelling units. <br /> <br /> The approval of this special use permit is conditioned <br />upon administrative approval of the amended site plan, which <br />shall include the following: <br /> <br />(a) Location of a bicycle storage rack/area; <br />(b) Details of replacement plantings along the <br /> outside of the proposed fence in.the area; and <br />(c) Details of the barbecue and picnic area proposed. <br /> <br />ORDINANCE: SOLID WASTE FEES <br /> <br /> Mr. Hendrix stated that the fees have been added to the <br />ordinance for both curb and dumpster service. <br /> <br /> Responding to a question from Ms, Slaughter, Mr. Hendrix <br />stated that the dumpster fees are proposed to increase by 3 <br />1/2 times and will reflect the same proportional share of the <br />cost as curbside customers. <br /> <br /> Responding to a question from Ms. Waters, Ms. Mueller <br />stated that the fee for a 32 gallon bag or can was increased <br />to 90 cents to include the cost of the subsidy and in <br />anticipation of a tip fee of $45. <br /> <br /> Ms. Waters stated that she would like to get periodic <br />reports regarding State mandates and what is driving up the <br />cost of the landfill and recommended increased dialogue on <br />the issue between State and local elected officials. <br /> <br /> Mr. Toscano stated that he felt the Rivanna Solid Waste <br />Authority should press the experts on what is really needed <br />in order to be environmentally careful. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Hendrix <br />stated that no staff will be available to monitor illegal <br />dumping in dumpsters, but the police can respond when a <br /> <br /> <br />
