138 <br /> <br />that this had been the city's rationale in court when a law <br />suit had been filed on the dumpster fees. <br /> <br /> Ms. Waters stated that she was concerned that rental <br />properties would be affected in the commercial rate. <br /> <br /> Responding to a question from Rev. Edwards regarding the <br />implications of keeping the current dumpster fees, Mr. Craig <br />Brown, Assistant City Attorney, stated that while he felt <br />having the same percentage would guarantee the City would <br />prevail in court if challenged on the dumpster fees, he did <br />not think the percentage necessarily needed to be the same. <br /> <br /> Responding to a question from Rev. Edwards, Mr. Hendrix <br />stated staff would have to do a financial analysis to see if <br />reducing the sticker fee to 75 cents and maintaining the <br />current dumpster fee would balance out. <br /> <br /> Mr. Louie Chapman, Assistant City Manager, stated that <br />the staff have been gearing up for a July 1st implementation <br />of the sticker system and have attempted to design a system <br />that makes sense and is enforceable. Twenty six stores have <br />agreed to distribute the stickers as a community service, and <br />six months' worth of free stickers will be provided to <br />persons meeting the eligibility requirements. Five employees <br />will be involved in enforcement of the ordinance and will be <br />able to issue citations for violations. <br /> <br /> Ms. Waters recommended that the Mayor write and thank <br />the managers of the stores who have agreed to sell the <br />stickers. <br /> <br /> It was suggested that students, especially at the <br />elementary schools, be given information regarding the <br />sticker system to take home and that members of <br />Charlottesville-Albemarle Recycle Together (CART) be asked to <br />help provide information at local grocery stores regarding <br />the stickers. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN SECTIONS 26-28, 26-37, 26-61, 26-64, AND 26-65 OF <br />CHAPTER 26 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, RELATED TO SOLID WASTE COLLECTION" was offered <br />and carried over to the next meeting for consideration. <br /> <br />ORDINANCE: REAL ESTATE TAX AND RENT RELIEF FOR ELDERLY AND DISABLED <br /> <br /> Mr. Hendrix explained that the ordinance would allow <br />permanently disabled persons who have previously received the <br />tax and rent relief to maintain that level of credit when <br />they reach age 65. <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Waters, <br />the ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />SECTIONS 25-58 AND 30-98 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1990, AS AMENDED, RELATED TO REAL ESTATE TAX <br />RELIEF AND RENTAL RELIEF FOR ELDERLY AND DISABLED PERSONS" <br />was offered and carried over to the next meeting for <br />consideration. <br /> <br />ORDINANCE: CEMETERY FEES <br /> <br /> Mr. Hendrix explained that as part of the budget <br />discussions staff had proposed and Council approved the <br />elimination of the City opening and closing graves which the <br />ordinance would carry out. Mr. Hendrix stated that <br />funeral directors have been notified of the ordinance and <br />have requested that Council postpone the matter to allow them <br />to make a statement, or to allow them to make a statement at <br />the second reading since the burden of the cost of this <br />service will now be shifted to the funeral directors. <br /> <br />Responding to a question from Ms. Slaughter, Mr. Hendrix <br /> <br /> <br />
