Edwards abstaining. <br /> <br /> WHEREAS, the Monticello Area Community Action Agency <br />(MACAA), contract purchaser of property located at 1025 Park <br />Street, has.requested a special use permit to use the former <br />YMCA site as a Community Education Center; this property <br />being further identified on City Real Property Tax Map #45 as <br />parcel 2, having approximately 70 feet of frontage on Park <br />Street, 626 feet of frontage on the 250 Bypass, and <br />containing approximately 343,557 square feet of land, or 7.89 <br />acres) <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on December 8, 1992, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a special use permit is hereby <br />granted to the Monticello Area Community Action Agency to use <br />the former YMCA site as a Community Education Center. <br /> <br /> The approval of this special use permit is conditioned <br />upon the following: <br /> <br />1o Administrative approval of the site plan. <br /> <br /> 2. A grading and soil erosion/sediment control plan <br />shall be submitted with an application, $50.00 fee, four <br />copies of the narrative and four plan copies prior to final <br />site plan approval. This plan shall be approved and bonded, <br />and shall include data on the linear feet of silt fence, <br />curbing and pipes as well as on the number and sizes of <br />drainage structures to assist in setting the bond amount. <br /> <br /> 3. The hours of operation by MACAA or any auxiliary <br />uses shall not exceed 9:00 p.m. on Sunday through Thursday, <br />11:00 p.m. on Friday and 10:00 p.m. on Saturday. <br /> <br /> 4. Ail site plan improvements must be implemented <br />within one year of the approval of the special permit, or all <br />uses will cease to operate until the improvements are <br />completed; provided, however, that twenty (20) of the ninety- <br />five (95) required parking spaces may be installed within two <br />(2) years of the approval of the special permit. <br /> <br /> 5. There shall be physical barriers on access roads <br />during prohibited hours of operation. <br /> <br />ORDINANCE: RECYCLING TAX CREDIT (2nd reading) <br /> <br /> Mr. Gouldman explained that a six-year sunset clause had <br />been added to the ordinance, as requested. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br />REORDAINING CERTAIN SECTIONS OF ARTICLE V OF CHAPTER 30 OF <br />THE CITY CODE RELATED TO SOLAR ENERGY EQUIPMENT TAX <br />EXEMPTIONS, AND ADDING A NEW DIVISION TO ARTICLE V OF CHAPTER <br />30 OF THE CITY CODE, 1990, AS AMENDED, RELATED TO RECYCLING <br />EQUIPMENT TAX EXEMPTIONS," which was offered at the December <br />21st meeting, was approved by the following vote. Ayes: Ms. <br />Daugherty, Ms. Slaughter, Mr. Toscano, Mr. Vandever. Noes: <br />None. Abstaining: Rev.
