299 <br /> <br />the $55,000 appropriation for equipment purchase for the <br />public access studio was offered and carried over to the next <br />meeting for consideration. <br /> <br /> Mr. Toscano explained that a total of $110,000 is being <br />paid to the City as part of the franchise agreement, with <br />$55,000 to be used for equip~ment purchase. Mr. Toscano noted <br />that another $30,000 will be paid by Adelphia in five years <br />for public access as part of the agreement. Mr. Toscano <br />stated that the public access facility should be operating by <br />June and training sessions will be provided by Adelphia. <br /> <br />RESOLUTION: RENEWING CAFE PERMIT FOR SAL'S RESTAURANT <br /> <br /> Mr. Giuseppe Finazzo, owner of Sal's Restaurant, <br />requested that he be allowed to move his outdoor cafe to the <br />east to take in the fountain and that the tables which had <br />been previously approved directly adjacent to the restaurant <br />be allowed prior to 5:00 p.m. <br /> <br /> It was agreed that Mr. Finazzo would be granted a <br />temporary permit for the existing cafe and the additional <br />requests would be considered at the next meeting to allow an <br />opportunity for staff to give a recommendation. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, <br />Sal's Restaurant was granted a three-week permit for the <br />existing outdoor cafe. <br /> <br />RESOLUTION: APPROVING SPECIAL PERMIT FOR MCINTIRE SPORTS CENTER <br />ON ALLIED STREET <br /> <br /> Mr. Huja~ stated that the Planning Commission recommended <br />approval of the special permit for the McIntire Sports Center <br />which would allow the addition of video games and up to four <br />pool tables for the following reasons: 1) It is in harmony <br />with the Comprehensive Plan's Land Use Plan; 2) It will not <br />have a significant adverse impact on the surrounding <br />neighborhood, due to the limited nature of use, the enclosure <br />of the activity and the fact that no additional exterior <br />changes to the building or sites are contemplated other than <br />a sign for the business and the parking lot construction with <br />landscaping~ 3) The proposed use is compatible with other <br />uses in the Allied Street Complex. <br /> <br /> Ms. Slaughter raised a question about the provision in <br />the ~resolution which would allow minors at the center during <br />school hours for an activity sponsored by the school and Mr. <br />Huja stated that attendance at the center could be used as an <br />incentive for special education classes. <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Slaughter, <br />the resolution granting a special permit to the McIntire <br />Sports Center was unanimously approved by Council. <br /> <br /> WHEREAS, Allied Realty Company, owner of the property <br />known as the McIntire Sports Center at '1729 and 1731 Allied <br />Street, has requested a special use permit for an amusement <br />arcade with video games and up to four pool tables at the <br />McIntire Sports Center; this property being further <br />identified as portions of Parcels 90.10A and 90.11 on City <br />Real Property Tax Map ~34, having approximately 115.5 feet of <br />frontage on Allied Street and containing approximately 13,398 <br />square feet of land, or .31 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on March 9, 1993, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code, and to the <br />specific criteria for special use permits in Section 34-439 <br />of said Code; now, therefore <br /> <br /> <br />
