236 <br /> <br /> WHEREAS, under the Intermodal Surface Transportation Efficiency Act (tSTEA) <br />certain funds are made available for enhancement projects; and <br /> <br /> WHEREAS, the project presented is construction of an ADA accessible pedestrian and <br />bicycle path from the existing greenbelt to Pen Park on the west side of the Rivanna (5,500') <br />and Darden Towe Park on the east side (5,100'). This project includes pedestrian steps and <br />an ADA accessible ramp; and <br /> <br /> WHEREAS, the project is in accordance with the Comprehensive Plan of the City of <br />Charlottesville, the Bicycle Plan of the MPO for both the City and Albemarle County; and <br /> <br /> WHEREAS, the project is deemed meritorious and of benefit to the community and <br />the State; and <br /> <br /> WHEREAS, in accordance with Commonwealth Transportation Board construction <br />allocation procedures, it is necessary that a request by resolution be received from the local <br />government in order that the Virginia Department of Transportation program an <br />enhancement project in the City of Charlottesville, Virginia; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Charlottesville, Virginia, requests the Commonwealth Transportation Board to establish a <br />project for the construction of an extension of the Rivanna Greenbelt trail. <br /> <br /> BE IT FURTItER RESOLVED, that the City of Charlottesville has sufficient capital <br />improvement funds and agrees to pay one-half of the "local 20% match" towards the total <br />cost of planning, design, right of way, and construction of this project (such total costs are <br />estimated at $150,000), in accordance with guidelines for ISTEA funding. This agreement is <br />conditioned upon an equal contribution being made by the County of Albemarle toward the <br />20% local match. It is estimated that each locality's share of the local match will be $15,000. <br /> <br /> BE IT FURTHER RESOLVED that, if the localities subsequently elect to cancel this <br />project, the City of Charlottesville agrees to reimburse the Virginia Department of <br />Transportation for one-half of the total amount of the costs expended by the Department <br />through the date the Department is notified of such cancellation. The County of Albemarle <br />will be responsible for reimbursing the Department the remainder (one-half) of such costs. <br /> <br /> Mr. Toscano stressed that the City will not be responsible for maintenance of the trail <br />on the County side unless it is part ofDarden Towe Park. <br /> <br />ORDINANCE: ZONING ORDINANCE AMENDMENTS <br /> <br /> Council discussed each zoning amendment separately, in the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDA1NING SECTIONS 34-4, 34-199, 34-378, <br />34-569, 34-576 AND 34-578 OF CHAPTER 34 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO BED AND BREAKFAST <br />ESTABLISHMENTS, COMPOSITION OF THE BOARD OF ARCHITECTURAL <br />REVIEW, AND APPLICATIONS AND NOTICE FOR DEMOLITION OF HISTORIC <br />STRUCTURES." <br /> <br /> Mr. Huja explained that one amendment would define bed and breakfast establishments, <br />allow them by right in B-1 zones, and by special permit in R-3 zones. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, Sections 34-4, 34-199, and <br />34-378 of the ordinance were offered and carried over to the next meeting for consideration. <br /> <br /> Mr. Huja said that the Planning Commission will be studying the issue of allowing bed <br />and breakfast establishments in R-1 and R-2 zones. <br /> <br /> Mr. Huja said that Section 34-569 changes the composition of the Board of <br />Architectural Review. <br /> <br /> <br />
