131 <br /> <br /> WHEREAS, a program planning study perfo_rmed for the City of Charlottesville and <br />the County of Albemar!e by Moseley-Harris & McClintock estimates the total project cost to <br />design and finance the construction of the Blue Ridge Juvenile Detention Center (the New <br />Facility) to be approximately $6.36 million dollars; and <br /> <br /> WHEREAS, the Participating Jurisdictions have requested the Virginia Department of <br />Juvenile Justice to approve state funding participation in the design, construction, equipping <br />and operation of the Blue Ridge Juvenile Detention Facility, in the maximum amounts <br />permitted by state law; and <br /> <br /> WI!EREAS, the City of Charlottesville and the County of Albemarle now wish to <br />create a regional juvenile detention commission, as authorized by Va. Code Sections <br />16. !-315 to 16.1-322, to be the appropriate legal entity to plan, finance, design, and <br />construct the New Facility; <br /> <br /> NOW, THE~FORE, BE IT CONCURRENTLY RESOLVED BY THE <br />BOARDS OF SUPERVISORS OF THE COUNTIES OF ALBEMARLE _AND <br />FLUVANNA, AND THE COUNC~ OF THE CITY OF CHARLOTTESVILLE, <br />THAT: <br /> <br /> !. The Blue Ridge Juvenile Detention Commission (the "Commission") is hereby <br />created and established as a public body corporate under the laws of the Commonwealth of <br />Virginia. <br /> <br /> 2. The Commission shall have three members, who shall be the respective county <br />administrator, county executive or city manager of each of the Participating Jurisdictions. As <br />required by Va. Code .Section 16.1-3 ! 6, the Participating Jurisdictions have consulted with <br />the chief judges oftheir respective juvenile and domestic relations district courts concerning <br />the appointment of the members to the Commission. <br /> <br /> 3. The Commission shall have al! powers and responsibilities conferred upon juvenile <br />detention commissions generally by Va. Code Sections 16.1-315 to 16.1-322 or successor <br />statutes, and by any other state laws. Without limiting the generality of this delegation of <br />powers and responsibilities, the Commission shall be authorized to: <br /> <br /> a. Develop a Service Agreement among the commission and the Participating <br />Jurisdictions to establish the basis on which the Participating Jurisdictions will commit <br />juveniles to custody in the New Facility. <br /> <br /> b. Take such actions as may be necessary to insure maximum allowable state <br />participation in the cost of constructing, equipping and operating the New Facility. <br /> <br /> c. Upon approval of the Service _Agreement by the Participating Jurisdictions, issue <br />such debt obligations as the Commission may deem necessary to fund the development of the <br />New Facility, including any costs incidental to the issuance of such debt, the establishment of <br />reasonable operating and debt service reserve, or any costs incurred by the Commission in <br />anticipation or execution of such development or the opening of the New Facility. <br /> <br /> d. Arrange for interim financing, from one or more of the Participating Jurisdictions <br />or otherwise, and agree to reimburse any of the Participating Jurisdictions for any sums <br />advanced or expenses incurred on the commission's behalf prior to the Commission's securing <br />permanent financing. <br /> <br /> e. Al:ter securing the necessary financing, proceed with the design, and construction <br />and equipping of the New Facility and employ architects, engineers, financial advisors, <br />attorneys, contractors and other technical experts as necessary to complete such project. <br /> <br /> 4. Any Participating Jurisdiction may withdraw unilaterally from membership in the <br />Commission at any time prior to its approval of the Service _Agreement.
