If approved, the lump sum payment of ~$35,872 would be subject <br />to Industrial Commission approval. <br /> <br /> Mr. Toscano noted that the funds would be taken from the <br />Risk Management fund, not the General Fund. <br /> <br /> On mOtion by Ms. Waters,~ seconded by Mr. Vandever, the <br />resolution approving the Workman's Compensation settlement <br />was unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia: <br /> <br /> It appearing to be in the best interests of the City, <br />and it being at the request of our employee, who is <br />respresented by counsel, we hereby approve a lump sum <br />settlement of a worker's compensation claim in the amount of <br />~34,872.00, all as agreed between staff and the employee <br />(whose name is not stated here for reasons of <br />confidentiality). The Director of Finance is hereby <br />authorized to make payment from the Risk,Management Fund in <br />accordance with the settlement terms. <br /> <br /> The approval hereby given for the entire settlement is <br />conditioned upon formal approval of the settlement by the <br />Industrial Commission of the State of Virginia~ <br /> <br />RESOLUTION: APPROVING INTERIM DRUG POLICY FOR GAS DIVISION <br /> <br /> Mr. O~Connell explained that the U. S. Department of <br />Transportation has required that anti-drug programs be in <br />place ~for gas system employees by August 21st. Mr. O'Connell <br />stated that the policy includes provisions for random ~and <br />reasonable cause testing. <br /> <br /> Mr. Toscano asked how the policy was developed, what the <br />penalties were for non-compliance, and which provisions were <br />mandatory. <br /> <br /> Mr. Gouldman replied that the policy was developed from <br />models used by the Department of Transportation and other <br />localities throughout the State, there are both civic and <br />criminal penalties for non-compliance, and the random testing <br />and reasonable cause provisions are mandated. Mr. Gouldman <br />recommended that barbituates and benzodiaziades be added to <br />the drugs tested. <br /> <br /> Concern was expressed about pre-employment tests and the <br />fact that the drugs recommended to be added were legal <br />prescription drugs. Mr. Toscano recommended that the section <br />regarding pre-employment tests be clarified. <br /> <br /> Ms. O'Connell stated that prior to testing~ employees <br />are given the opportunity to disclose what medications they <br />are presently taking. · <br /> <br /> Mr. Vandever raised questions about alcohol abuse and <br />Mr. O'Connell explained that alcohol was covered by the <br />City's current substance abuse policy. <br /> <br /> On motion by Ms. Waters, seconded by Ms. Slaughter, the <br />interim drug policy for the gas division, as amended by Mr. <br />Toscano and with the addition of barbituates and <br />benzodiaziades, was unanimously approved by Council. <br /> <br /> WHEREAS, the U.S. Department of Transportation (DOT) has <br />adopted regulations requiring natural gas operators with 50 <br />or fewer employees to begin drug testing of certain employee <br />positions by August 21, 1990~ and <br /> <br /> WHEREAS, the DOT requirements differ from the City's <br />Substance Abuse Policy in several areas, including a <br />requirement for random testing for illegal drugs on a regular <br /> <br /> <br />
