72 <br /> <br />Transportation Board; and <br /> <br /> WHEREAS, a statement of policy agreed upon between the <br />said Director and Board approves the use of such funds for <br />the construction of access roads to publicly-owned <br />recreational areas; and <br /> <br /> WHEREAS, it appears to the Council of the City of <br />Charlottesville ("the Council") that all requirements of the <br />laws have been met to permit the Director of Conservation and <br />Recreation to designate McIntire Park as a recreational <br />facility and further permit the Commonwealth Transportation <br />Board to provide access funds for access to this public <br />recreation area in accordance with Virginia Code Section <br />33.1-223, as amended; and <br /> <br /> WHEREAS, the Council acknowledges that pursuant to the <br />provisions of Virginia Code Sections 33.1-223 and 33.1-62, as <br />amended, the access road shall be designated a "Virginia <br />Byway" and recommends the Commonwealth Transportation Board <br />in cooperation with the Director of ConServation and <br />Recreation take the appropriate .action to implement this <br />designation. Further the Council agrees, in keeping with the <br />intent of Virginia Code Section 33.1-63, to use its good <br />offices to reasonably protect the aesthetic and cultural <br />value of this road~ <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the <br />City of Charlottesville that the Director of Conservation and <br />Recreation is requested to desiqnate the McIntire Park as a <br />public recreational area; and to recommend to the <br />Commonwealth Transportation Board that recreational access <br />funds be allocated for an access road to serve said park; and <br /> <br /> BE IT FURTHER RESOLVED, that the Council of the City of <br />Charlottesville gives its assurances that matching funds will <br />be provided dollar for dollar from the McIntire Park project <br />fund for all recreation access funds contributed in excess of <br />$250,000 up to the maximum contribution allowable, and that <br />if additional funding is needed to complete the road <br />construction, that additional funding will be provided for in <br />full from the McIntire Park project fund; and <br /> <br /> BE IT FURTHER RESOLVED, that the Commonwealth <br />Transportation Board is hereby requested to allocate the <br />necessary recreational access funds to provide a suitable <br />access road as hereinbefore described. <br /> <br />ORDINANCE: TAXICAB FARES (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br />REORDAINING SECTION 16.1 OF ARTICLE II OF CHAPTER 27 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE,- 1976, AS AMENDED, <br />RELATING TO TAXICAB RATES," which was offered at the June <br />19th meeting, was approved by the following vote. Ayes: Mr. <br />Buck, Rev. Edwards, Mr. Towe, Mr. Vandever, Ms. Waters. <br />Noes: None. <br /> <br />ORDINANCE: EXPANDING PERMIT PARKING ZONE 2 <br /> <br /> Mr. Hendrix stated that a petition to include Dunova <br />Court in permit parking zone 2 had been received and a survey <br />showed that Dunova Court had a 93% vehicle occupancy rate, <br />82% being commuter parking. Mr. Hendrix explained that the <br />ordinance would expand the area eligible for permit parking <br />and the next step would be for Council to designate permit <br />parking on a block by block basis. <br /> <br /> Concern was noted about expanding the permit parking <br />zone to an area larger than may be necessary. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Vandever, the <br />ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br /> <br /> <br />
