166 <br /> <br /> Mr. O'Connell explained that the resolution was required <br />by the Department of Transportation in order for the Free <br />Bridge project to move on to the Transportation Board and <br />would approve the general location of the project and the <br />major design features. Mr. O'Connell stated that the <br />specific design of the bridge, wall and pedestrian walk was <br />not included~in the design approval at this time. <br /> <br /> On motion by Mr. Towe, seconded by Mr. Vandever, the <br />resolution approving the design and location of the Free <br />Bridge project was unanimously approved by Council. <br /> <br /> WHEREAS, a Location and Design Public Hearing was <br />conducted on July 18, 1989, in the City of Charlottesville by <br />representatives of the Commonwealth of Virginia, Department <br />of Transportation after due and proper notice for the purpose <br />of considering the proposed location and design of the Route <br />250 East Highway Improvement Project (0250-104-102) in the <br />City of Charlottesville, at which hearing aerial photographs, <br />drawings and other pertinent information were made available <br />for public inspection in accordance with state and federal <br />requirements; and ~ <br /> <br /> WHEREAS, all persons and parties in attendance were <br />afforded full opportunity to participate in said public <br />hearing; and <br /> <br /> WHEREAS, representatives of the City of Charlottesville <br />were present and participated in said hearing; and <br /> <br /> WHEREAS, .the Council had previously requested the <br />Virginia Department of Transportation to program this <br />project; and <br /> <br /> WHEREAS, representatives of the City of Charlottesville <br />and the Virginia Department of Transportation are continuing <br />to work on the final design of this project, including bridge <br />design, fence and wall materials and provisions for <br />pedestrians~ and <br /> <br />WHEREAS, the Council considered all such matter; now <br /> <br /> THEREFORE, BE IT RESOLVED that the Council of the City <br />of Charlottesville hereby approves the location and major <br />design features of the proposed project as presented at the <br />Public Hearing; and <br /> <br /> BE IT FURTHER RESOLVED that the City of Charlottesville <br />requests the Virginia Department of Transportation to acquire <br />all rights of way necessary for this project conveying said <br />rights of way to the City at the appropriate time; and <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby <br />authorized to execute, on behalf of the City of <br />Charlottesville, all necessary railroad and utility <br />agreements required in conjunction with acquiring such rights <br />of way. <br /> <br />ORDINANCE: <br /> <br />TRUST <br /> <br />CONVEYING CARLTON AVENUE RIGHT-OF-WAY TO CHARNAN LAND <br /> <br /> Mr. O'Connell stated that a sign encroaches on the <br />City's right-of-way and staff recommended that the Council <br />approve a quitclaim deed. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Vandever, the <br />ordinance entitled "AN ORDINANCE TO AUTHORIZE THE CONVEYANCE <br />OF A PARCEL OF LAND LOCATED ON THE CORNER OF CARLTON AVENUE <br />AND CARLTON ROAD TO THE CHARNAN LAND TRUST" was offered and <br />carried over to the next meeting for consideration. <br /> <br />PUBLIC <br /> <br /> <br />
