267 <br /> <br />RESOLUTION: <br /> <br />STREET <br /> <br />APPROVING SPECIAL USE PERMIT FOR 601-609 E. MARKET <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that the Planning Commission recommended approval of <br />the special use permit for the following reasons: 1) It is <br />in harmony with the Comprehensive Plan; and 2) It will not <br />have a significant adverse impact on the surrounding area. <br /> <br /> On motion by Mr. Buck, seconded by Mr. Vandever, the <br />special use permit for 601-609 E. Market Street was <br />unanimously approved bY Council, with Rev. Edwards and Ms. <br />Waters absent. <br /> <br /> WHEREAS, Gabriel Silverman, trustee for Town~ Square <br />Associates, owner of property located at 601-609 East Market <br />Street at 7th Street, N.E., has requested a special use <br />permit to allow for jewelry manufacturing of a craft nature <br />to take place in the "Old Michie Building" at 601-609 E. <br />Market Street, being further identified on City Real <br />Property Tax Map ~53 as parcel 100, having approximately <br />201.5 feet on frontage on East Market Street, 168 feet of <br />frontage on 7th Street, N.E., and 183.5 feet of frontage on <br />6th Street, N.E., and containing approximately 33,978 square <br />feet of land, or .78 acres~ <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on May 8, 1990, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code; now~ therefOre, <br /> <br /> BE IT RESOLVED, by the Council of the City of <br />Charlottesville, Virginia~that Town Square Associates is <br />hereby granted a special.use permit to allow for jewelry <br />manufacturing of a craft nature to take place in the "Old <br />Michie Building"~at 601-609 E Market Street, pursuant to <br />City Code section 31-93 - <br /> <br />RESOLUTION: APPROVING SPECIAL USE PERMIT FOR SEVENTH DAY <br />ADVENTIST DAY CARE AT 2437 JEFFERSON PARK AVENUE <br /> <br /> Mr. Hendrix explained that approval of the special use <br />permit would increase the enrollment of the day care center <br />from 70 to 90 children. ~ <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br />denial of the special use permit for the following reasons: <br />1) The site is too smali for the increased usage when <br />compared to other such facilities in the community; 2( It is <br />contrary to the Land Use Plan of the Comprehensive Plan; 3) <br />The proposed use could have an adverse impact on the <br />surrounding tneighborhood in terms of noise and~ inadequate <br />buffer; 4) Inadequate buffer area exists for the proPosed and <br />potential increase in the number of children based on <br />comparisons with similar and larger facilities; and 5) The <br />history of enrollment in this facility and the agreements on <br />maximum number of Children allowed indicate that 70 children <br />is the maximum that should be allowed there legally. <br /> <br /> Mr. Hendrix acknowledged~receipt of a copy~of the day <br />care center's license which allows for up to 92 students, <br />but added that this information was already available to <br />staff and the Planning Commission. <br /> <br /> Mr. Buck moved to deny the special use permit for the <br />Seventh Day Adventist Day Care Center, adding that he did so <br />reluctantly ~because of the need for day care in the <br />community, but that the permit could not be granted on the <br />merit of th~ program alone, but on the appropriateness ~of the <br />land use and the impact on the surrounding neighborhood. <br /> <br /> <br />
