AN ORDINANCE. <br />TO AMEND AND REORDAIN SECTION 31-276 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />RELATING TO CONDUCT DECLARED UNLAWFUL UNDER THE <br />CITY ZONING ORDINANCE. <br />BE IT ORDAINED by the Council of the City of Charlottesville <br />that §31-276 of the Code of the City of Charlottesville, 1976, is <br />amended and reordained as follows: <br />Section 31-276. Conduct declared unlawful. <br />The following conduct is hereby declared to be unlawful: <br />(a) Violation of any provision of this chapter or of any <br />regulation adopted pursuant to authority conferred by it; <br />(b) Failure to comply with the provisions, requirements, <br />conditions or standards contained in any approved site plan, <br />grading plan, excavation plan or clearing plan or in any special <br />permit, building permit occupancy permit, variance or certificate <br />of appropriateness; <br />(c) Failure of the owner of any property for which a site <br />plan, permit or other official approval has been granted under this <br />chapter or Chapters 9 or 26.1 of this code to maintain improvements <br />required under the terms of such approval (including but not limited <br />to pedestrian walkways, vehicular travel lanes or driveways, parking <br />areas, fences, walls, curbs and gutters, signs, screening or land- <br />scaping, soil erosion devices or drainage improvements) in a condition_ <br />which ensures protection of the public safety and general welfare. <br />It is the purpose of this section to ensure that those site improve- <br />ments intended for benefit of the public or protection of adjacent <br />properties, but not dedicated to public use or otherwise transferred <br />to city ownership, are maintained in a condition which permits those <br />intentions to be fulfilled. <br />{e} (d) Procurement of any amendment or any required permit, <br />certificate or approval through misrepresentation of any material <br />fact. <br />Adopted by Council <br />January 19, 1981 <br />Copy teste: <br />Clerk of Council <br />
