AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 31-279.1 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, RELATING TO SUSPENSION OF TIME <br />LIMITS ON PERMITS, CERTIFICATES OR APPROVALS <br />DURING LITIGATION. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that Section 31-279.1 of the Code of the City of <br />Charlottesville, 1976, as amended, is amended and reordained as <br />follows: <br />Section 31-279.1. Suspension of time limits on <br />permits, certificates and other <br />approvals during litigation. <br />Whenever any provision of this chapter or of chapter 5, 9 or <br />26.1 of this Code imposes a time limit upon the validity of a <br />permit, certificate, variance, site plan, plat or other official <br />approval granted thereunder and the validity of such permit, <br />certificate, variance, site plan, plat or other official approval <br />is raised as an issue in any judicial proceeding to which the <br />city or the receipient of such approval is a party, and such time <br />limitation is reached during the pendency of the judicial pro- <br />ceeding, then such approval shall be extended to a date six twelve <br />months beyond the date of a final, non -appealable order by a court <br />of competent jurisdiction terminating the litigation. <br />irtrga-t x=-rS-peTtdkrrg <br />Approved by Council <br />June 6, 1983 <br />Atteste: <br />11'1J <br />FAY <br />83-7-14 <br />
