No such building permit shall be issued by the zoning adminis- trator unless: (a) A certificate of appropriateness has been issued for the purpose by the appropriate board ef-arehiteetaral-review to the owner thereof; and (b) The location, construction, reconstruction, alteration, repair or demolition thereof otherwise complies with the requirements of the Virginia Uniform Statewide Building Code and other ordinances and laws applicable and relating thereto exeegt;-as-etkerw#se-grey#�e� im-this-artsele. Section 31-147. Exclusions. Nothing in this article shall be construed to prevent: (a) The ordinary maintenance or repair of any exterior elements of any building or structure; (b) The construction, reconstruction, alteration or demolition of any such elements which the authorized city officers shall certify • as required for public safety. Section 31-147.1. Appeals. (a) Any decision of the board of architectural review or the downtown board of architectural review may be appealed to the city council. The decision of the city council may thereafter be appealed to the Circuit Court for review by the owner (or his agent) of the property for which the decision was sought or any adjacent property owner. The appealing bodyaP rty shall file a petition at law, setting forth the alleged illegality of the action taken. and Any appeal shall be filed within thirty days after the final decision has been rendered. (b) Any decision of the city council designating areas to be protected according to the provisions of this article and of §31-127.1 may be appealed to the Circuit Court for review by the owner, or his agent, of any property so affected, by any property owners or agents notified in accordance with §31-273. The appealing body party shall file a petition at law setting forth the alleged illegality of the action taken. and Any appeal shall be filed within thirty days after the final decision has been rendered. • (c) The filing of an appeal petition pursuant to subsections (a) and (b) shall stay the decision of the body pending the outcome
