12. <br />demolished unless a permit therefor is issued by the zoning adminis- <br />trator. No such building permit shall be issued by the zoning adminis- <br />trator unless: <br />(a) A certificate of appropriateness has been issued for the <br />purpose by the appropriate board ef-arehiteetaral-review to the owner <br />thereof; and <br />(b) The location, construction, reconstruction, alteration, <br />repair or demolition thereof otherwise complies with the requirements <br />of the Virginia Uniform Statewide Building Code and other ordinances <br />and laws applicable and relating thereto exeegt;-as-etkerw#se-grey#�e� <br />im-this-artsele. <br />Section 31-147. Exclusions. <br />Nothing in this article shall be construed to prevent: <br />(a) The ordinary maintenance or repair of any exterior elements <br />of any building or structure; <br />(b) The construction, reconstruction, alteration or demolition <br />of any such elements which the authorized city officers shall certify <br />• as required for public safety. <br />Section 31-147.1. Appeals. <br />(a) Any decision of the board of architectural review or the <br />downtown board of architectural review may be appealed to the city <br />council. The decision of the city council may thereafter be appealed <br />to the Circuit Court for review by the owner (or his agent) of the <br />property for which the decision was sought or any adjacent property <br />owner. The appealing bodyaP rty shall file a petition at law, <br />setting forth the alleged illegality of the action taken. and Any <br />appeal shall be filed within thirty days after the final decision has <br />been rendered. <br />(b) Any decision of the city council designating areas to be <br />protected according to the provisions of this article and of §31-127.1 <br />may be appealed to the Circuit Court for review by the owner, or his <br />agent, of any property so affected, by any property owners or agents <br />notified in accordance with §31-273. The appealing body party shall <br />file a petition at law setting forth the alleged illegality of the <br />action taken. and Any appeal shall be filed within thirty days after <br />the final decision has been rendered. <br />• (c) The filing of an appeal petition pursuant to subsections <br />(a) and (b) shall stay the decision of the body pending the outcome <br />
