(h) Removal of trash. All trash or debris accumulating <br />• <br />within twenty feet of any vending stand shall be collected <br />by the vendor and be disposed of in a proper trash container. <br />(i) Vending to vehicles. No vendor shall solicit or <br />sell to persons in motor vehicles on the street adjacent to <br />his or her stand. <br />Section 25-49. Additional requirements for certain vendors. <br />(a) Vendors of food and beverages must provide receptacles <br />for trash as part of their stands. <br />(b) Vendor stands other than those of adjacent businesses <br />permitted under sections 25-46(b) and 25 47(b) shall have an <br />attendant present at all times. <br />Section 25-50. No property right in vendor location. <br />Nothing contained in this article shall create a permanent <br />property right for any adjacent owner or other vendor in the <br />vending location used by such person pursuant hereto. City <br />Council reserves the right to modify or repeal this ordinance <br />• at any time. Any vendor shall comply immediately with the <br />lawful request of any police officer, firefighter, rescue <br />service person, or city or public utility employee to move <br />his or her stand for emergency reasons or to permit maintenance <br />of the pavement, utilities or other public facilities. <br />Section 25-51. Review by Boards of Architectural Review. <br />(a) All applications for vending from a stand within <br />the Architectural Design Control or Downtown Architectural <br />Design Control District, as delineated on the zoning district <br />map pursuant to Article XVI of Chapter 31 of this Code, <br />shall be referred to the applicable board of architectural <br />review for issuance or denial of a certificate of appropriateness <br />regarding an applicant's proposed stand and related signs. <br />(b) The applicable board shall issue or deny a certificate <br />of appropriateness regarding an applicant's proposed stand <br />based upon consideration of the criteria established in <br />Chapter 31 of this Code. <br />(c) Each board shall, as soon as practicable after <br />adoption of this article, develop uniform guidelines and <br />• criteria to delegate review and approval of certificates of <br />appropriateness of vendor stands, displays or decorative <br />objects permitted hereunder to the zoning administrator. <br />However, any applicant may appeal the ruling of the zoning <br />administrator to the applicable board. <br />-5- <br />
