AN ORDINANCE <br />TO AUTHORIZE THE SALE OF PROPERTY LOCATED <br />AT THE INTERSECTION OF MONTICELLO AVENUE AND DRUID AVENUE, <br />AND TO AUTHORIZE THE MAYOR'S SIGNATURE ON THE DEED OF CONVEYANCE. <br />WHEREAS, the City of Charlottesville no longer has any use for <br />a parcel of land which it owns, located at the intersection of <br />Monticello Avenue and Druid Avenue, in the City of Charlottesville, <br />being approximately 4,960 square feet in area and identified as <br />Parcel `X' on the attached copy of City Tax Map 60; and <br />WHEREAS, Claude Cotten has asked the City to convey this <br />parcel of land to him because he owns all properties adjoining this <br />parcel and wishes to combine this parcel with Parcel 237 on City <br />Tax Map 60; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the sale of Parcel `X' described above to Claude W. <br />Cotten for the sum of $4,355 is hereby authorized, and the Mayor <br />is hereby authorized to execute a quitclaim deed, in form approved <br />by the City Attorney. The deed shall contain restrictions running <br />with the land that limit land use development in the following <br />ways: <br />1. No buildings shall be constructed on the property by Mr. <br />Cotten or any future owners of the property; <br />2. The property shall be maintained solely as an open space <br />landscaped area, including sufficient frontage plantings <br />of trees and shrubs to screen any parking areas beyond <br />this property; <br />3. No curb cut entrance shall be permitted onto Monticello <br />Avenue from this property. <br />Upon adoption of this ordinance, Claude Cotten will furnish <br />a formal plat of Parcel `X' adequate to become a part of any deed <br />of conveyance. <br />Approved by Council <br />February 5, 1990 <br />C erk of City Council <br />0-7-2 <br />0- <br />
