• Section 26-31. Certain wastes not to be collected by city. <br />Factory cuttings, trade wastes or rejected building materials <br />will not be collected by the city. They may be hauled to an <br />approved landfill by the property owner or the owner's agent. <br />Hot ashes shall not be collected by the City <br />Section 26-32. Placement for collection of garbage or refuse <br />from outside City. <br />It shall be unlawful for any non-resident of the City or any <br />owner of a business not situated within the City limits, or any <br />agent of either, to bring bagged, boxed or bundled household or <br />business garbage or refuse from outside the City into the City and <br />deposit it anywhere herein for collection by the public service <br />division of the public works department. <br />ARTICLE III. USER FEES FOR COMMERCIAL REFUSE CONTAINERS <br />Section 26-35. Purpose and policy. <br />This article is adopted pursuant to Virginia Code <br />§15.1-11.5:3, §15.1-879 and §15.1-857 in order to better protect <br />• the health, safety and welfare of the public and the environment by <br />establishing a fee for the city service of disposing of refuse <br />generated by commercial property owners located within city <br />boundaries. <br />Section 26-36. Definitions. <br />The following words, terms and phrases, when used in this <br />chapter, shall have the meanings ascribed to them in this section, <br />except where the context clearly indicates a different meaning: <br />Commercial property for purposes of this article shall mean <br />all properties, residences or businesses in the city which: (1) on <br />the average generate refuse each week which would fill more than <br />twelve (12) thirty-two gallon containers; (2) deposit their refuse <br />in dumpsters, as defined herein; and (3) are otherwise eligible to <br />have their refuse collected and disposed of by the city. <br />Dumpster means a large refuse container with a minimum <br />capacity of at least two cubic yards and capable of being lifted <br />mechanically by frontloading city refuse trucks. <br />Refuse means garbage, trash, debris, litter and other solid <br />waste which the City regularly collects as part of its curbside <br />collection and which can be disposed of by the City at the Ivy <br />Landfill. This does not include hazardous waste, white goods, <br />• furniture, tires, automobile parts, asbestos and inert waste such <br />as dirt, logs, rock, construction materials, brush (unless tied in <br />bundles less than 3 feet long) or demolition debris. <br />C! <br />
