The City police department and substations located at 724G <br />Prospect Ave., 817D Hardy Dr., 531 2d St. S.E. Suite 12A, Frank Ix <br />Bldg. (NSB); and Forrest Avenue; <br />Meadow Creek Golf Course Club House; and <br />C. In areas where Grantee provides Internet service over the System, <br />upon Grantor's request, Grantee will provide one outlet and any required <br />terminal equipment (i.e., cable modem) for Internet services without <br />charge for each school and library so long as such school or library is <br />located within 150 feet of the cable distribution plant. <br />D. Should City construct or move any of the aforementioned facilities <br />beyond 300 feet of the existing System, as upgraded, Grantee shall not be <br />required to absorb the Installation costs for such facilities until such time <br />as Grantee extends its System to accommodate same. <br />E. Prior to the design of the rebuild of the Cable System, Grantee shall <br />provide a proposal to the City for the provision of two pair of dedicated • <br />fiber to all state accredited K-12 public schools as set forth in Exhibit D, as <br />part of the System upgrade/rebuild required under this Franchise. This <br />dedicated fiber may be used by the schools for voice, video and data <br />applications by and between schools and school districts and/or for the <br />distribution of educational access programming to the Grantee's Cable <br />System. <br />5.06 Technical Standards. The System shall be designed, constructed and <br />operated so as to meet those technical standards promulgated by the FCC <br />relating to Cable Systems contained in Part 76 of the FCC's rules and regulations <br />as may, from time to time, be amended. The results of tests required by the FCC <br />will be delivered to the City within thirty (30) days of the completion of testing. <br />5.07 Special Testing. <br />A. City shall have the right to inspect and test all construction or <br />Installation work performed pursuant to the provisions of the Franchise. In <br />addition, City may require special testing of a location or locations within <br />the System as desired at any time during the term of this Franchise. <br />Demand for such special tests may be made on the basis of Complaints <br />received or other evidence indicating an unresolved controversy or <br />noncompliance or for routine verification of Grantee's compliance with <br />FCC technical and other applicable standards.
