• resolution, be advertised for a joint public hearing before the <br />City Council and the Planning Commission, with the following <br />changes: <br />(a) Substitute the proposed text attached hereto as <br />Exhibit "Y" as the entire text for Sec. 34-146 (the proposed text <br />for R -1A Permitted Uses - by Right). <br />(b) Add a severability clause as a new section at the end of <br />the R-lA text which shall read as follows: "If any part, section <br />subsection, sentence, clause or phrase of this article is for any <br />reason declared to be unconstitutional or invalid, such decision <br />shall not affect the validity of the remaining portions of this <br />article." <br />(c) Change the Proposed new zoning map by adding back in the <br />proposed new "B-5" zoning district with the same boundaries as <br />initially advertised for the February 12, 1991, public hearing. <br />(d) Insert Article XIV -A B-5 Business District (§§34-470 <br />through 34-478) into the text using the same language which was <br />initially advertised for the February 12, 1991, joint public <br />hearing.except for the changes shown in the next subparagraph as it <br />relates to the B-5 business district. <br />• (e) Change the proposed "height and bulk" regulations as shown <br />below: <br />1. B-4, § 34-467, make the set back 25' rather than <br />15' after the first 40' of building height. <br />2. B-5, § 34-474 (February 12, 1991, text) make the <br />maximum building height 701rather than 851. <br />3. B-5, § 34-474 (4) (Feb. 12, 1991, text). First two <br />sentences should be amended to read: "The maximum <br />height of the street wall shall be forty feet. A <br />minimum of 75% of the street wall is required to be <br />within 15' of the property line." <br />4. B-5, § 34-476 (1) - (4) (February 12, 1991, text). <br />Should be changed into just three sections and <br />amended to read: <br />(1) Front yard: No front yard is required, but <br />after 40 feet of building height, there shall be a <br />25 foot setback for at least 75% of the street wall <br />above 40 feet high. <br />(2) Side yard(s): Requirements for side yards <br />shall be the same as.required in the B-1 Business <br />District. <br />2 <br />
