A RESOLUTION AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE IMPROVEMENTS IN THE UVA-CORNER AREA WHEREAS, this Council has, at a public hearing held on December 2, 1991, considered and agreed to certain street, sidewalk, and related improvements in the University of Virginia - Corner area (the "Corner Area") generally in accord with the preliminary design suggestions made by the landscape architectural firm of EDAW, INC. (the "Architects"); and WHEREAS, the Corner Area under consideration includes those properties which front along the following streets: Segment (1) - along the north side of University Avenue from Chancellor Street to its intersection with Elliewood Avenue; Segment (2) - along both sides of Elliewood Avenue from University Avenue to the north boundary of Parcel 96, Tax Map 9; Segment (3) - on the north side of University Avenue from Elliewood Avenue to its intersection with 14th Street; Segment (4) - along both sides of 14th Street, NW from University Avenue to its intersection with Wertland Street; and Segment (5) - on the north side of University Avenue from 14th Street, NW to its intersection with 13th Street, NW; and WHEREAS, by notices duly advertised in the Daily Progress as required by §15.1-244 of the Code of Virginia, the Council has given notice of its intention to consider improving such Corner Area in the general manner as described above, and to create a special assessment district comprised of the properties abutting such improvements; and WHEREAS, pursuant to such notice, this Council has, at its regular meeting on December 2, 1991, duly conducted a public hearing at which the owners of such abutting properties were heard for or against such improvements; as required by §§ 15.1-239 et sem. of the Code of Virginia, as amended; now therefore be it RESOLVED by the Council of the City of Charlottesville: A. That the Corner Area street scape improvements including, but not limited to, the replacement of sidewalks and street pavement, in some instances with special paving materials and in others with regular paving materials, the replacement and expansion of facilities for storm water drainage and the installation of lighting, landscaping, benches, waste receptacles and other permanent amenities, is hereby approved for the Corner Area. B. That a special assessment district be created comprising all parcels of land abutting such improvements and that such properties be assessed a portion of the cost of such improvements in the manner authorized by the last cited state code provisions and as more particularly described in the attached Exhibit A • entitled " An Abstract of Resolution"; but in no event shall the costs of such assessments exceed fifty percent (50%) of the total costs of the improvements;
