the public intrest would best be served by requiring the owner to postpone the demolition and to <br />• make a bona fide offer to sell the structure and land, all as provided in more detail in the City <br />Code and in Virginia Code &15.2-2306. <br />The property must be offered at a price reasonably related to the fair market value of the structure <br />and land and must be made to the city, or to any person or firm or agency that gives reasonable <br />assurance that it is willing to preserve and restore the property. Any offer within ten percent of <br />the current assessed value will be considered to meet this requirement. <br />The time during which the offer to sell must remain open varies according to the price. The <br />minimum time period (when the offering price is $25,000) is three months, while the maximum <br />(for prices $90,000 or higher) is twelve months. <br />If such a bona fide offer to sell is not accepted within the designated time period, the owner will <br />be entitled to a certificate of appropriateness which permits the demolition of the structure. <br />DEMOLISHING HISTORIC STRUCTURES <br />Review Criteria and Guidelines for Demolition <br />The following general criteria or standards should be applied in decisions made by the BAR is <br />• regard to demolishing protected buildings: <br />1. The criteria established by the City Code found in §34-568(b) and §34-577(b), which criteria <br />read as follows: <br />(a) The historic, architectural or cultural significance, if any, of the structure or site and <br />whether it has been listed on the National Register of Historic Places or the Virginia Landmarks <br />Register. <br />(b) The association of the structure or site with an historic person or event or with a <br />renowned architect or master craftsman. <br />(c) The overall condition and aesthetic quality of the site or structure and whether it is or <br />would be an integral part of an existing design control district. <br />(d) The age of the structure. <br />(e) Whether the structure is of such old or unusual design, texture and material that it can <br />be reproduced only with great difficulty, if at all. <br />(fl The degree to which the original distinguishing character, qualities or materials of a <br />structure have been retained. <br />• <br />Charlottesville Historic District Design Guidelines: Demolition and Moving 2 <br />
