44 <br /> <br />and Housing Authority's Vinegar Hill Urban Renewal Account <br />was offered and carried over to the next meeting for <br />consideration. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR ANIMAL HOSPITAL AT 820 <br />DALE AVENUE <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that the Planning Commission recommended approval of <br />the special permit for an animal hospital, without outside <br />runs or pens on the property, for the following reasons: 1) <br />It is in conformity with the Land Use Plan of the <br />Comprehensive Plan; and 2) It will not have a significant <br />adverse impact on the surrounding area if conditions are <br />met. Mr. Huja stated that the Planning Commission <br />conditioned this approval upon the following: 1) <br />Administrative approval of the site plan with r~ecommended <br />changes; 2) The curb cut access onto Preston Avenue be <br />eliminated and two-way access to Forrest Street be pursued; <br />3) A grading and soil erosion/sediment control plan be <br />submitted for approval; 4) The building be adequately <br />soundproofed to prevent noises from impacting adjacent <br />properties and result in zero sound transmission at the <br />property line; 5) That drainage from interior pens be <br />appropriately provided for into the sanitary sewer system; <br />6) That there be a green buffer between Mr. Tinsley's <br />property and the subject property unless negotiated <br />differently and that adequate screening be provided for <br />other residential property; 7)That organic waste not be <br />left unsecured on site~ and 8) That the sidewalk connection <br />to Dale Avenue be eliminated. Mr. Huja stated that the <br />noise concern had been further discussed and it was <br />recommended that the noise level be regulated in the <br /> construction of a building with a 50 STC requirement. Mr. <br /> Huja stated that he felt this was reasonable and <br /> enforceable. <br /> <br /> Mr. Towe commended Dr. Wood for his cooperation in <br />reaching agreement on the land sale and special permit. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />Council unanimously approved the special permit for the <br />animal hospital for 820 Dale Avenue, as recommended by <br />the Planning Commission, including the conditions listed <br />above, except for the requirement of 50 STC in the <br />construction of the building substituted for condition ~4. <br /> <br /> WHEREAS, Dr. Charles H. Wood, Jr. has requested a <br />special use permit to construct a small animal hospital <br />without outside runs or pens at 820 Dale Avenue; <br /> <br /> WHEREAS; following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on November 11, 1987, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special use permit is <br />hereby granted to allow Dr. Charles H. Wood, Jr. to construct <br />a small animal~hospital without outside runs or pens at 820 <br />Dale Avenue. This property is further identified on City <br />Real Property Tax Map ~31 as Parcels 1 (Lot 6) and 4.1, and <br />Lots 4 and 5 on Parcel 5, having approximately 50 feet of <br />frontage on Dale Avenue, 150 feet of frontage on Preston <br />Avenue, 30 feet of frontage on Rose Hill Drive, frontage on a <br />15' alley~ and containing approximately 11,850 square feet of <br />land. <br /> <br /> This special use permit is subject to those conditions <br />imposed by the Planning Commission at the joint public <br />hearing with the exception fo Condition #4 requiring a zero <br />decibel reading at the property line.
