3 <br /> <br />scenic river designation does the following: 1) requires <br />government agencies to consider the scenic and other <br />values of a river in the Planning process, 2) requires <br />authorization by the state legislature of any project <br />which is subject to state approval that might impede the <br />natural flow of a river -- such as a dam or the interbasin <br />transfer of water, 3) by requiring the Governor to appoint <br />an advisory committee of local people, it gives riparian <br />landowners, local citizens and local governments greater <br />say in federally or state-approved projects affecting the <br />river, and 4) allows riparian landowners to continue using <br />their land as they did before designation. Mr. Imhoff <br />stated that scenic river does not do: I) does not carry <br />any land use controls or regulations, 2) does not <br />authorize any state agency to condemn land for <br />recreational or other purposes (use of the power of <br />eminent domain is specifically prohibited), 3) does not <br />affect a riparian landowner's right to use the river or <br />its banks for grazing, irrigation, etc., and 4) does not <br />bring with it any federal controls, rules, or regulations. <br />Mr. Imhoff requested a resolution of support from the <br />Council in order to show support to the state legislature. <br /> <br /> Mrs. Gleason questioned whether scenic river <br />designation would have any impact on the municipality's <br />water rights. <br /> <br /> Ms. Imhoff responded that she did not feel it would <br />impact any water rights, but would look into the matter. <br /> <br /> Dr. Hall questioned whether any improvements to the <br />river would be made as a result of the designation. <br /> <br /> Ms. Imhoff stated that the Piedmont Environmental <br />Council would organize projects that would involve some <br />clean up of the river banks, and noted that scenic river <br />designation would become a consideration of site plans in <br />Albemarle County. <br /> <br /> Mr. Towe questioned what action Albemarle County had <br />taken on the request made to them. <br /> <br /> Ms. Imhoff stated that the Albemarle County Board of <br />Supervisors had referred the matter to staff for further <br />study. <br /> <br /> Mr. Buck stated that while he felt the designation <br />would be positive, he recommended referring the matter to <br />staff so that a review of the impact on municipal and <br />citizen operations could be made. <br /> <br /> Mr. Hendrix stated that staff would report back to <br />Council by the end of August or first of September. <br /> <br />APPROPRIATION: <br /> <br />(2nd reading) <br /> <br />$61,995 - YOUTH SERVICE CENTER GRANT <br /> <br /> The $61,995 appropriation of the Youth Service <br />Center Grant which was offered at the July 21st meeting, <br />was approved by the following vote. Ayes: Mr. Buck, Mrs. <br />Gleason, Dr. Hall, Mr. Towe. Noes: None. Absent: Mr. <br />Barnes. <br /> <br /> WHEREAS, the virginia Department of Corrections has <br />notified the City of its grant award under the Virginia <br />Delinquency Prevention and Youth Development Act; now, <br />therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that $61,995 is hereby <br />appropriated from the grants fund to expenditure account <br />number 11-12070 for operation of a youth service center <br />during the 1986-1987 fiscal year.
