10 <br /> <br />unanimously approved by Council. <br /> <br />REQUEST: PAVING RECYCLING CENTER - CHARLOTTESVILLE ALBEMARLE <br />CLEAN COMMUNITY COMMISSION <br /> <br /> Mr.O'Connell stated that the Charlottesville- <br />Albemarle Clean Community Commission (CAC3) had requested <br />that the surface of the recycling center on McIntire Road <br />be repaired and it was staff's recommendation to spend <br />$2~500 for surface treatment. <br /> <br /> Mr. Roger Flint, a board member of CAC3, stated that <br />CAC3 agreed with staff's recommendation. <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Barnes, <br />$2,500 worth of surface treatment was authorized for the <br />recycling center by Council. <br /> <br />REQUEST: APPROVAL OF SETTLEMENT OF CLAIM <br /> <br /> Mr. O'Connell stated that a lawsuit had been filed <br />against the City and it was staff's recommendation for the <br />City's to approve $7~500 to settle the claim. <br /> <br /> Mr. Barnes stated that he concurred with the <br />recommendation given the certainty of the claim. <br /> <br /> Mr. Barnes made a motion to authorize $7,500 for the <br />settlement of the claim, Mrs. Gleason seconded the motion <br />and it was unanimously approved by Council. <br /> <br />STAFF REPORT: RIVANNA RIVER BANK STABILIZATION <br /> <br /> Mr. O'Connell stated that $200,000 had been left <br />undesignated in the Capital budget, pending approval by <br />Council for the repair of the erosion occurring at Pen <br />Park. Mr. O'Connell stated that engineering and <br />architectural reports had been received and it was <br />recommended that the river bank be repaired with rip-rap <br />and a stone wall at a cost of $142,000. Mr. O'Connell <br />stated that the two greens and the irrigation pond could <br />be lost if the work is not done. Mr. O'Connell requested <br />that Council authorize the repairs so that the work can be <br />put out to bid. <br /> <br /> Mrs. Gleason questioned whether the estimate would <br />include raising the level of the pond. <br /> <br /> Mr. John Berberich, City Engineer, stated that the <br />level would not be raised, but that the damage to the pond <br />would be corrected. <br /> <br /> Mr. O'Connell noted that it was hoped that the <br />action recommended at this time would correct the problem, <br />but that should further action be necessary, Council would <br />be approached in the future. <br /> <br /> Mr. Buck questioned whether the gravel business <br />operated across the river from the golf course contributed <br />to the problem. <br /> <br /> Mr. Berberich stated that he understood that the <br />gravel business may have contributed to the problem. <br /> <br /> Mr. Wiley stated that he had never before heard that <br />the gravel business was a contributing factor, but he <br />would look into the matter. <br /> <br /> Mr. O'Connell stated that it was his understanding <br />that the gravel business may be relocating in the near <br />future. <br /> <br />Mr. Barnes requested that staff pursue the legal <br /> <br /> <br />
