154 <br /> <br />for the construction of access roads to publicly-owned <br />recreational areas; and <br /> <br /> WHEREAS, it appears to the Board of Supervisors of <br />ALbemarle County ("the Board") and the Council of the City <br />of Charlottesville ("the Council")that all requirements of <br />the laws have been met to permit the Director of <br />Conservation and Historic Resource to designate the Rivanna <br />Park as a recreational facility and further permit the <br />Virginia Highway and Transportation Commission to provide <br />funds for access to this public recreation area in <br />accordance with Virginia Code Section 33.1-223, as amended; <br />and <br /> <br /> WHEREAS, the Board acknowledges that pursuant to the <br />provisions of Virginia Code Sections 33.1-223 and 33.1-62, <br />as amended, the access road shall be designated a "Virginia <br />Byway" and recommends the State Highway and Transportation <br />Board in cooperation with the Director of Conservation and <br />Historic Resources take the appropriate action to implement <br />this designation. Further the Board agrees, in keeping with <br />the intent of Virginia Code Section 33.1-63, to use its good <br />offices to reasonably protect the aesthetic and cultural <br />value of this road; <br /> <br /> NOW, THEREFORE, BE IT JOINTLY RESOLVED, by the Board of <br />Supervisors of ALbemarle County and the Council of the City <br />of Charlottesville that the Director of Conservation and <br />Historic Resources is requested to designate the Rivanna <br />Park as a public recreational area; and to recommend to the <br />State Highway and Transportation Commission that <br />recreational access funds be allocated for an access road to <br />serve said park; and <br /> <br /> BE IT FURTHER RESOLVED, that the Board and Council give <br />their respective assurances that matching funds will be <br />provided dollar-for-dollar from the Rivanna Park project <br />fund for all recreation access funds contributed in excess <br />of $200,000 up to the maximum contribution allowable, and <br />that if additional funding is needed to complete the road <br />construction, that additional funding will be provided for <br />in full from~the Rivanna Park project fund; and <br /> <br /> BE IT FURTHER RESOLVED, that the Virginia Highway and <br />Transportation Commission is herby requested to allocate the <br />necessary recreational access funds to provide a suitable <br />access road as hereinbefore described. <br /> <br />RESOLUTION: REQUESTING ADVANCE ACQUISITION OF PROPERTY ADJACENT <br />TO FREE BRIDGE BY HIGHWAY DEPARTMENT <br /> <br /> Mr. Hendrix stated that the resolution would request <br />advance acquisition of property adjacent to Free Bridge as <br />the property is presently being improved and may be needed <br />when improvements are made to Free Bridge. Mr. Hendrix <br />stated that acquisition is preferable before additional <br />improvements are made. <br /> <br /> Mr. Buck stated that the resolution is necessary in <br />order to allow negotiations to begin between the property <br />owner and the Highway Department, though the property will <br />only be acquired if necessary for the Free Bridge project. <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, the <br />resolution requesting advance acquisition of property <br />adjacent to Free Bridge by the Highway Department was <br />unanimously approved by Council. <br /> <br /> WHEREAS, Section 33.1-89 of the Code of Virginia, as <br />amended by the 1970 Session of the General Assembly, <br />authorizes the Department of Transportation Commissioner to <br />acquire rights of way for the construction, reconstruction, <br />alteration, maintenance and repair of public highways within <br /> <br /> <br />
