municipalities on projects which are constructed with State <br />or Federal participation; and <br /> <br /> WHEREAS, Section 33.1-89, as amended, further provides <br />that the Department of Transportation Commissioner may <br />exercise such authority only upon receipt of official <br />request from the city or town involved; now <br /> <br /> THEREFORE, BE IT RESOLVED, that the City Council of <br />Charlottesville hereby requests that the Department of <br />Transportation Commissioner acquire the necessary rights of <br />way for Project: 0250-104-102, PE101, RW201, within the <br />Corporate Limits of said City and to convey the title to <br />such right of way to the City Council of Charlottesville and <br />agrees to reimburse the Virginia Department of <br />Transportation for five percent (5%) of all costs incurred <br />in the acquisition of such rights of way, and it is <br />understood that such acquisitions will be handled by the <br />Commissioner under established policies and procedures; and <br />his decision in all instances shall be final. <br /> <br />RESOLUTION: AUTHORIZING TRANSIT GRANT APPLICATION <br /> <br /> Ms. Judith Mueiler, Director of Public Works, stated <br />that an application was being made by the Metropolitan <br />Planning Organization through the Charlottesville Transit <br />Service for an UMPTA grant which would develop an overall <br />marketing plan to produce a booklet on transportation <br />alternatives, targeting the University students and staff <br />and encouraging use of public transportation. The grant <br />would be $53~500, with the local share being $2,600 ($800 <br />from the City, $400 each from Albemarle County and the <br />University, and $400 from the private sector). Mr. Mueller <br />stated that should the grant be received, the program would <br />begin in August of 1987. <br /> <br /> Responding to a question from Mr. Barnes, Ms. Mueller <br />stated that the program could publicize handicapped <br />transportation. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the <br />resolution authorizing the transit grant application was <br />unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the City Manager is <br />authorized to execute and file an application to the <br />Virginia Department of Highways and Transportation, <br />Commonwealth of Virginia, for a grant of transportation <br />special revenues, under Chapter 643 budget item C.13, of the <br />1986 Acts of Assembly ("the Act"), to conduct an <br />experimental mass transportation/ridesharing project; and to <br />accept from the Virginia Department of Highways and <br />Transportation grants in such amount as may be awarded; and <br />to authorize the Transit Manager to furnish to the Virginia <br />Department of Transportation such documents and other <br />information as may be required for processing the grant <br />request. <br /> <br /> The City Council certifies that the funds shall be used <br />in accordance with the requirements of the Act; that the <br />record of receipts and expenditures of funds granted the <br />City of Charlottesville Department sof Highways and <br />Transportation and by the State Auditor of Public Accounts; <br />and that funds granted to the City for defraying up to 95% <br />of the net cost of the City's mass transportation or <br />ridesharing project of the City of Charlottesville shall be <br />used only for purposes authorized in the Act. The City <br />guarantees that five percent (5%) of the net project costs <br />will be provided from local funding sources. <br /> <br /> The City will evaluate the project and seriously <br />consider continuing the service after state funding ends, <br /> <br /> <br />
