274 <br /> <br />hereby granted pursuant to City Code Sections 31-14(c) and <br />31-14(e) to operate a private, noncommercial recreational <br />facility for group use and a child daycare facility on the <br />aforesaid property. Such special permit shall be subject to <br />the conditions imposed~by the City zoning ordinance upon <br />special permits generally and shall further be subject to <br />the following special conditions: <br /> <br /> 1) That the daycare facility be limited to a maximum <br />enrollment of 75 children. <br /> <br /> 2) That the YMCA submit and Obtain administrative <br />approval of a final site plan and soil erosion and sediment <br />control plan prior to occupancy of the site. <br /> <br /> 3) That the site plan show a redesigned entranCe and <br />exit at the Route 250 Bypass westbound access ramp to permit <br />right turns only into and out of the property at that <br />location. <br /> <br /> 4) That the site plan show the location of 108 required <br />parking spaces on the site. <br /> <br /> 5) That prior to occupancy the YMCA post a bOnd or <br />other financial guarantee acceptable to the City Attorney <br />for 100% of the estimated cost of all incomplete require <br />site plan improvements, including the redesigned access road <br />and the full 108 parking spaces. Such guarantee shall <br />remain in effect for two years from occupancy. However, the <br />YMCA shall not be required to construct the redesigned <br />access road nor to increase the parking spaces beyond the 93 <br />spaces currently in existence during the first year of <br />occupancy. During that initial year the Director of <br />Planning and Community Development and the City Traffic <br />Engineer shall monitor traffic and parking conditions on and <br />around the site. They shall report to the City Manager not <br />later than September 1, 1988 their recommendations on <br />whether the additional 15 parking spaces and the redesigned <br />entrance and exit are necessary. The City Manager shall <br />decide and notify the YMCA not later than October 1, 1988 <br />whether either or both such requirements must be met, and <br />the YMCA shall thereafter proceed promptly to comply. If <br />these items are not required and other requirements are <br />complete, the bond or guarantee may then be released. <br /> <br /> BE IT FURTHER RESOLVED that upon issuance of a <br /> certificate of occupancy for the recreational and daycare <br /> facilities covered by this~special permit, the special <br /> permits granted to the Charlottesvlile Area Family YMCA for <br /> operation of recreational and daycare facilities at the <br /> McIntire School site on U.S. Route 250 Bypass, Birdwood <br /> Road, Hillcrest Road and Edgehill Road approved by this <br /> Council on May 19, 1980, December 16, 1985 and November 3, <br /> 1986 shall be rescinded and declared null and void. <br /> <br />RESOLUTION: AUTHORIZING MAYOR TO SIGN DEDICATION OF RIGHT-OF-WAY <br />ON STATE RT. 742 (AVON ST. EXTD.) PUBLIC WORKS CENTER <br /> <br /> Mr. Wiley stated that Albemarle County was requiring <br />the right-of-way dedication in connection with the Site plan <br />for the Public Works Center. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the <br />resolution authorizing the Mayor to sign a dedication of <br />right-of-way on State Rt. 742 (Avon St. Extd.) for the <br />Public Works Center was unanimously approved by Council. <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, that the Mayor is hereby authorized to <br />execute on behalf of the City the following document, in <br />form approved by the City Attorney: <br /> <br />A deed of dedication from the City of Charlottesville <br /> <br /> <br />
