272 <br /> <br /> WHEREAS, folloWing a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on August 11, 1987, this Council finds that such use <br />will conform to the standards set forth in Section 31-220 of <br />the City Code and to the criteria applicable to special <br />permits generally under Chapter 31 of the City Code; now, <br />therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia tha the special use permit <br />originally granted May 20, 1985 and extended and amended <br />November 3, 1986 and May 4, 1987 is further amended to allow <br />the Covenant School to operate a private school facility on <br />the entire mcIntire School site. Such property is further <br />identified on City Real Property Tax Map ~45 as Parcel 7, <br />having approximately 430 feet of frontage on the U.S. Route <br />250 Bypass,' 570 feet of frontage on Birdwood Road, 590 feet <br />of frontage on Edgehill Road, and 600 feet of frontage on <br />Hillcrest Road, and containing approximately 315,500 square <br />feet of land or 7.24 acres. <br /> <br /> This special use permit, as amended, is conditioned <br />upon continued compliance with the requirements for special <br />permits generally set forth in Chapter 31 of the City Code <br />and upon the following special conditions and limitations: <br /> <br /> 1) Student enrollment in the school shall be limited to <br />a maximum of 300. <br /> <br /> 2) No outdoor interscholastic athletic activities shall <br />be permitted on the site. <br /> <br /> 3) No daycare or afterschool care program shall be <br />conducted on the site without further amendment of this <br />special permit. <br /> <br /> 4) The Covenant School shall submit and obtain <br />administrative approval of a completed site plan, including <br />all measures recommended by the City Planning Commission and <br />shall post a full performance bond or other financial <br />guarantee acceptable to the City Attorney before obtaining a <br />temporary certificate occupancy and occupying the premises <br />for the 1987-88 school year. <br /> <br /> 5) No regular evening programs shall be conducted at <br />the school other than occasional parent-teacher meetings, <br />social events or indOor athletic events, or similar <br />incidental uses. <br /> <br /> 6) Entrance and exit access roads shall be designed and <br />properly marked for one-way travel and paved with a hard <br />surface. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR YMCA TO USE HERITAGE <br />SCHOOL PROPERTY <br /> <br /> Mr. Higgins stated that the Planning Commission had <br /> been concerned about the impact of the increased traffic due <br /> to the YMCA's use of the Heritage School property, <br /> especially on Park Street, and requested that the Council <br /> have staff evaluate the traffic safety issues near the Park <br /> Street entrance to the old Heritgage School site with <br /> possible speed limit reductions to 25 mph or signage <br /> solutions considered. The Planning Commission recommended <br /> approval for the following reasons: 1) It is in harmony <br /> with the Land Use Plan of the Comprehensive Plan; and 2) It <br /> will not have a significant adverse impact on tyhe <br /> surrounding area if conditions are met. This approval is <br /> conditioned upon the following: 1) The site plan be revised <br /> and approved administrativelY; 2) A grading and soil <br /> erosion/sediment control plan will have to be submitted for <br /> review and approval prior to final site plan approval; 3) <br /> <br /> <br />
