283 <br /> <br /> Mr. Hendrix stated that this resolution would guarantee <br />that the City would complete the turn lanes off of Avon <br />Street Extended at the entrance to the new Public Works <br />Center. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, <br />Council unanimously approved the resolution guaranteeing <br />completion of turn lanes off Avon Street Extended. <br /> <br /> WHEREAS, the City of Charlottesville owns certain <br />property along Route 742 in Albemarle County by deed dated <br />September 29, 1986 recorded in the Albemarle County Circuit <br />Court Clerk's Office at Deed Book 904, page 209; <br /> <br /> WHEREAS, the City is developing some of this property <br />for a public works center pursuant to a site plan currently <br />filed with and approved by Albemarle County~ <br /> <br /> WHEREAS, certain work which is required as a condition <br />of site plan approval will be within the highway <br />right-of-way and will require a permit from the Virginai <br />Department 6f Transportation (the work shown on the plans <br />prepared by Gloeckner, Lincoln & Osborne entitled "Route 742 <br />Turn Lanes" dated November 26, 1986 and last revised June <br />17, 1987); and <br /> <br /> WHEREAS, the City of Charlottesville entered into a <br />Road Maintenance Agreement dated August 20, 1987 (attached <br />as Exhibit A) with The MC Partnership, the owner of property <br />adjacent to the above described City property situated on <br />the southeast side of State Route 742 (Avon Street <br />Extended), by which agreement the City agreed to assume all <br />of The MC Partnership's responsibility for completion of the <br />requirements of Permit No. 7-78488 issues to The MC <br />Partnership by the Virginia Department of Highways and <br />Transportation for work along State Route 742 near its <br />intersection with State Route 1101; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that: <br /> <br /> 1. The City requests that the Virginia Department of <br />Transportation issue a permit to the City to complete the <br />work shown on the plans prepared by Gloeckner, Lincoln & <br />Osborne entitled "Route 742 Turn Lanes" dated November 26, <br />1986 and last revised June 17, 1987. The City requests that <br />VDOT accept this Council resolution in lieu of a bond. <br /> <br /> 2. The City requests that VDOT substitute the City for <br />The MC Partnership under its previously issued Permit No. <br />7-78488, extend the City's time for completion of work under <br />this permit for a reasonable time beyond its current_ <br />expiration date of September 17, 1987, and accept this <br />Council resolution in lieu of the required performance bond. <br /> <br /> 3. The City guarantees completion of the work <br />described or incorporated by reference in items 1 and 2 <br />above to the satisfaction of VDOT. <br /> <br />RESOLUTION: AUTHORIZING MAYOR TO SIGN MUTUAL BOUNDARY LINE <br />RELOCATIOON AGREEMENT (PEN PARK) <br /> <br /> Mr. Hendrix stated that the revenue sharing agreement <br />with Albemarle County had included the right of the City to <br />annex Pen Park and this agreement, which has been approved <br />by Albemarle County, will be submitted to the Circuit Court <br />Judge following approval by the City. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the <br />resolution authorizing the Mayor to sign the Mutual Boundary <br />Line Relocation Agreement for Pen Park was unanimously <br />approved by Council. <br /> <br /> <br />
