283 Mr. Hendrix stated that this resolution would guarantee that the City would complete the turn lanes off of Avon Street Extended at the entrance to the new Public Works Center. On motion by Dr. Hall, seconded by Mrs. Gleason, Council unanimously approved the resolution guaranteeing completion of turn lanes off Avon Street Extended. WHEREAS, the City of Charlottesville owns certain property along Route 742 in Albemarle County by deed dated September 29, 1986 recorded in the Albemarle County Circuit Court Clerk's Office at Deed Book 904, page 209; WHEREAS, the City is developing some of this property for a public works center pursuant to a site plan currently filed with and approved by Albemarle County~ WHEREAS, certain work which is required as a condition of site plan approval will be within the highway right-of-way and will require a permit from the Virginai Department 6f Transportation (the work shown on the plans prepared by Gloeckner, Lincoln & Osborne entitled "Route 742 Turn Lanes" dated November 26, 1986 and last revised June 17, 1987); and WHEREAS, the City of Charlottesville entered into a Road Maintenance Agreement dated August 20, 1987 (attached as Exhibit A) with The MC Partnership, the owner of property adjacent to the above described City property situated on the southeast side of State Route 742 (Avon Street Extended), by which agreement the City agreed to assume all of The MC Partnership's responsibility for completion of the requirements of Permit No. 7-78488 issues to The MC Partnership by the Virginia Department of Highways and Transportation for work along State Route 742 near its intersection with State Route 1101; now, therefore BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that: 1. The City requests that the Virginia Department of Transportation issue a permit to the City to complete the work shown on the plans prepared by Gloeckner, Lincoln & Osborne entitled "Route 742 Turn Lanes" dated November 26, 1986 and last revised June 17, 1987. The City requests that VDOT accept this Council resolution in lieu of a bond. 2. The City requests that VDOT substitute the City for The MC Partnership under its previously issued Permit No. 7-78488, extend the City's time for completion of work under this permit for a reasonable time beyond its current_ expiration date of September 17, 1987, and accept this Council resolution in lieu of the required performance bond. 3. The City guarantees completion of the work described or incorporated by reference in items 1 and 2 above to the satisfaction of VDOT. RESOLUTION: AUTHORIZING MAYOR TO SIGN MUTUAL BOUNDARY LINE RELOCATIOON AGREEMENT (PEN PARK) Mr. Hendrix stated that the revenue sharing agreement with Albemarle County had included the right of the City to annex Pen Park and this agreement, which has been approved by Albemarle County, will be submitted to the Circuit Court Judge following approval by the City. On motion by Mrs. Gleason, seconded by Dr. Hall, the resolution authorizing the Mayor to sign the Mutual Boundary Line Relocation Agreement for Pen Park was unanimously approved by Council.
