201 <br /> <br />permanent easement, shown on the attached plat, across property designated as Parcel 53 on <br />City Tax Map 42B (known as 1708 Yorktown Drive), owned by Alena V. Hammond and <br />Nancy B. Brannock, Trustee ("Owner"); and <br /> <br /> WHEREAS, bona fide efforts have been made to acquire the easement by purchase <br />from the Owner, but the efforts have been ineffectual because of the inability of the parties to <br />agree on the price or terms of sale of the easement; and <br /> <br /> WHEREAS, the City has no recourse but to acquire the easement for this proposed <br />public use through the exercise of its power of eminent domain as authorized by the Code of <br />Virginia and the Charter of the City of Charlottesville; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the Mayor and Council support and endorse the natural gas line <br />expansion project and concur that its installation and the acquisition of the easement satisfy a <br />public purpose and necessity; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, Virginia <br />that the City is authorized to acquire the easement and to enter upon the property of Alena V. <br />Hammond and Nancy B. Brannock, Trustee, to install the natural gas facilities, as provided in <br />Sections 33.1-119 and 33.1-120 of the Code of Virginia (1950), as amended; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, Virginia <br />that the City Attorney is hereby authorized and directed to institute eminent domain <br />proceedings (including those authorized under Article 7 of Title 33.1 of the Code of Virginia) <br />to acquire the said easement across property identified as Parcel 124 on City Tax Map 42A, <br />and to execute such instruments as may be necessary for the proceedings. <br /> <br />g. ORDINANCE: <br /> <br />Inoperative Motor Vehicles (2nd reading) <br /> <br />h. ORDINANCE: <br /> <br />Removal of Refuse Contains in Commercial Areas <br /> <br />PRESENTATION: $350,000 WASHINGTON PARK RENOVATIONS <br />APPROPRIATION <br /> <br /> M_r. O'Connell explained that Phase I of the Washington Park renovations are <br />underway, and this appropriation will fund Phase II of the recommended renovations. <br /> <br /> Mr. Bill Letteri, Project Manager for Public Works, said that the design for Phase II is <br />complete, and will include a recreation center, basketball courts, and play areas. Mr. Letteri <br />said that a working committee composed of Parks staff, two design firms and several <br />members of the community were actively involved in the design process. <br /> <br /> Ms. Haley Boyce, landscape architect with Gregg Bleam Associates, said that 20 <br />community meetings had been held on the proposed renovations. Ms. Boyce reviewed the <br />design plan for Phase II and Phase III. <br /> <br /> Mr. Letteri summarized the budget for the Park renovations, and noted that fundraising <br />efforts are underway to augment funding for Phase III renovations at the lower part of the <br />park. Mr. Letted said that $66,000 has been raised to date in this effort. <br /> <br /> Ms. Slaughter said she hopes that the interior of the recreation center will be designed <br />to reduce the level of noise inside and that the tot playground will not be located in a remote <br />area, <br /> <br /> Respon¢ir~g to a q¢.estion from Mr. Toscano, Mr. Letted said that if the project comes <br />in over budg6t, less coj¢Jd be done to the lower section of the park. <br /> <br /> <br />
