217 <br /> <br /> WHEREAS, Wade Tremblay, on behalf of Wade Apartments Land Trust, has <br />requested a special use permit to allow occupancy of the residence at 1025 Wertland <br />Street by up to six (6)unrelated persons instead of the four (4) allowed by right. This <br />property is further identified as Parcel 312 on City Real Property Tax Map 4, having <br />approximately 71.5 feet of frontage on Wertland Street and containing approximately <br />30,245 square feet of land or .7 acres; <br /> <br />WHEREAS, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on September 14, I999, this Council <br />'finds that such use wilt conform to the criteria applicable to special permits get. rally <br />under Chapter 34 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council ofthe City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to Wade Apartments Land Trust, <br />owner of the property at 1025 Wertland Street to allow occupancy of the residence at that <br />address of up m six (6) unrelated persons. This special use permit is conditioned upon <br />completion of the site plan as approved and amended <br /> <br />RESOLUTION: ~PROVING SPECIAL PERMIT FOR HIGHER DENSITY FOR <br />! 00 WEST MAIN STREET <br /> <br /> Mr. Tolbert explained that Oliver Kuttner has received conditional approval from <br />the Board of Architectural Review for his plan for 100 West Main Street and he has gone <br />back to his original architect and plan for up to 28 units. Mr. Tolbert said that the <br />Planning Commission recommended approval of the special use permit for up to 28 <br />residential units consisting of four efficiencies at 400-560 square feet; 21 one-bedroom <br />units at 530-1425 square feet; and three two-bedroom units at 1030-1060 square feet for <br />the following reasons: 1) It is in harmony with the Land Use Plan of the Comprehensive <br />Plan; 2) The proposed use will not have any significant adverse impact on the <br />surrounding area if conditions are met; and 3) The smaller number of units can be <br />accomplished within the building mass as approved. Mr. Tolbert said that Mr. Kuttner is <br />planning to make a request to close the street at a later time, but added that the building <br />can be used if the street closing is not approved, though it will require some interior <br />redesign. Mr. Kuttner said the special permit is conditional on the owner submitting a <br />request for the street closing or a request to purchase a portion of the street. <br /> <br /> Mr. Caravati said that the BAR usually does not deal with interior units and he <br />sees no compelling reason to require it. <br /> <br />Mr. Tolbert said that the owner suggested the interior configuration. <br /> <br /> Mr. Caravati made a motion to approve the special use permit and Ms. Richards <br />seconded the motion. <br /> <br /> Mr. Caravati said he has heard concerns from neighbors on the mall about how <br />long this project has taken as it has caused them inconvenience and problems. In addition, <br />Mr. Caravati noted that Building and Life Safety has had enforcement problems with the <br />project. <br /> <br /> Mr. Tolbert said staff wilt continue to monitor the project and will stay on the <br />owner. <br /> <br /> The resolution granting a special use permit for higher density for 100 West Main <br />Street was approved by the following vote. Ayes: Mr. Caravati, Ms. Daugherty, Ms. <br />Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. <br /> <br /> WItEREAS, Oliver Kuttner, on behalf of Hampshire Investments Ltd., has <br />requested a special use permit to allow for the addition of up to forty (40) dwelling units <br />to the property at I00 West Main Street and 1~t Street South on the downtown mall at a <br />density of 105 dwelling units per acre instead of the 21 dwelling units per acre allowed <br />by right. This property is fu~_ her identified as Parcel 19 on City Real Property Tax Map <br />19, having approximately 76 feet of frontage on West Main Street, 227 feet of frontage <br /> <br /> <br />
