241 <br /> <br />Book 1865, page 533, and those additional property rights <br />conveyed by a Corrected Quitclaim Deed dated November <br />24, 1997, of record in the aforesaid Clerk's Office in Deed <br />Book 1659, page 404. <br /> <br /> WItEREAS, bonafide efforts have been made to acquire the Property by <br />purchase from the Owner, but the efforts have been ineffectual because of the inability to <br />agree on the price or terms of sale of the property; and <br /> <br /> WltEREAS, the City has no recourse but to acquire the ProperVy through the <br />exercise of its power of eminent domain as authorized by the Code of Virglnia and the <br />Charter of the City of Charlottesville; <br /> <br /> NOW, TltEREFORE, BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the Mayor and Council support and endorse the storm <br />drainage project being instituted in order to stabilize Moore's Creek and thereby protect <br />Azalea Park and concur that its installation and the acquisition of the Property satisfy a <br />public purpose and necessity; and <br /> <br /> BE IT FURTItER RESOLVED by the Council of the City of Charlottesville, <br />Virginia that such a public necessity is hereby declared to exist for the acquisition of the <br />Property in order to fulfill the public purpose of providing improved storm drainage <br />facilities in the Azalea Park area; and <br /> BE IT FURTItER RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the City is authorized to acquire the Property to install certain storm <br />drainage facilities, as provided in Sections 33.1-1 t9 and 33.1-120 of the Code of Virginia <br />(1950), as amended; and, <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the City Attorney is hereby authorized and directed to institute eminent <br />domain proceedings (including those authorized under Sections 33.1-119 and 33.1-120 of <br />the Code of Virginia) to acquire the Property described herein and to execute such <br />instruments as may be necessary for the proceedings <br /> <br />c. APPROPRIATION: <br /> <br />$21,000- Sobriety Checkpoint Grants <br />(2~a reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, <br />that the sum of $21,000.00, to be received as two (2) grants fromthe Department <br />of Motor Vehicles, is hereby appropriated to expenditure account 11-270-041171 <br />in the Grants Fund for the purpose of funding overtime pay to support the Sobriety <br />Checkpoint program administered by the Charlottesville Police Department. This <br />appropriation is conditioned upon receipt of a $I 0,000.00 grant and an $ I 1,000 <br />grant from the Virginia Department <br /> <br />ORDINANCE: "AN ORDINANCE CLOSING, VACATING <br />AND DISCONTINUING PORTIONS OF CASTALIA STREET" <br />(carried over') <br /> <br />OTltER BUSINESS <br /> <br /> Mr. Cox said Council has repeatedly gotten reports of crimes in the Prospect and <br />Garrett Square neighborhoods. Mr. Cox said the Piedmont Housing Alliance has <br />developed a listing of things that could be done on Prospect to create greater stability. <br />Mr. Cox asked what the City is doing to address the situation. <br /> <br /> Ms. Daugherty said she is also very concerned about the situation and has met <br />with the neighbors and staff in Building and Life Safety and Police Department. Ms. <br />Daugherty said she is interested in ways to increase home ownership in the neighborhood <br /> <br /> <br />
