APPROPRIATION: Year-End Adjustments (carried over) <br /> <br />c. ORI)INANCE: "AN ORX)INA2qCE TO AUTHORIZE AN <br />EXCHANGE OF PROPERTY ON EAST MARKET STREET BETWEEN THE <br />CITY AND MAIN STREET RETAIL PARTNERS, LLC" (2nd reading) <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br />RESOLUTION: ENDORSING HATE CRIME LEGISLATION <br /> <br /> Ms. Richards requested that Council amend the City's Legislative Package by a <br />letter supporting hate crime laws in the General Assembly. Ms. Richards said that <br />Council previously apProved such a resolution, though it was rejected by the General <br />Assembly. Ms. Richards said she would like Council to reaffirm their commitment to <br />that resolution, to include sexual orientation, and presented a resolution to Council. <br /> <br /> Mr. Toscano said that since Council has just received the resolution proposed by <br />Ms. Richards, he would prefer to be consistent with last year's language. <br /> <br />Mr. Cox said he would support reaffmning last year's language. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Caravati, Council asked the Mayor <br />to send a letter to the City's representatives in the General Assembly, reaffirming the <br />resolution approved previously supporting hate crime legislation by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. ToScano. Noes: None. <br /> <br /> On motion by Ivls. Richards, seconded by Mr. Toscano, Council voted (Ayes: Mr. <br />Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None.) to close <br />the open meeting and go into a closed session for the purpose of appointing members to <br />various City boards or agencies, as authorized by Section 2.1-344(A)(1) of the Virginia <br />Code; and for the purpose of consultation with legal counsel and briefings by staff <br />members, consultants or attorneys on two matters pertaining to actual or probable <br />litigation, where such briefing in an open meeting would adversely affect the negotiating <br />or litigating position of the City, or consultation with legal counsel employed or retained <br />by a public body regarding specific legal matters requiring the provision of legal advice <br />by such counsel, as authorized by Section 2.1-344(A)(7) of the Virginia Code. <br /> <br /> Council reconvened in open session and, on motion by Mr. Toscano, seconded by <br />Ms. Richards, approved the following certification of closed meeting by the following <br />vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: <br />None. <br /> <br /> WHEREAS, the City Council has convened a closed meeting on this date pursuant <br />to an affirmative recorded vote and in accordance with the provisions of the Virginia <br />Freedom of Information Act; and <br /> <br /> WHEREAS, Section 21.344.1 of the Code of Virginia requires a certification by <br />the Council that such closed meeting was conducted in conformity with Virginia law; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby certifies <br />that, to the best of each member's knowledge, (i) only public business matters lawfully <br />exempted from open meeting requirements by Virginia law were discussed in the closed <br /> <br /> <br />
