Noes: None. <br /> <br />ORDINANCE: REZONING 1308 EAST MARKET STREET FROM R-lA TO B-1 <br /> <br /> Mr. Tolbert said that a request has been rcmde to rezone t308 East Market Street, <br />a single family house, from R-IA to B-1 which will allow the property to be used for <br />office use if the need arises. Mr. Tolbert said it was found that the property was zoned <br />for business in the 1970's. Mr. Tolbert said the Planning Commission recommended <br />denial ofthe rezoning. <br /> <br /> Responding to a question from Mr. Caravati, Mr. Tolbert said the Planning <br />Commission recommended denial because they were concerned that other things might <br />come into play &wing the Comprehensive Plan process and because they did not want to <br />see the character of the building diminished. <br /> <br /> Ms. Daugherty said she will vote to rezone the property, though she appreciates <br />the Planning Commission's view. Ms. Daugherty said that she feels that in this case the <br />property is too disturbed by what is going on around it in ma~factufing zones, and feels <br />the B-1 zoning is appropriate transitional zoning. Ms. Daugherty noted that the <br />neighborhood supports the rezoning. <br /> <br /> Mr. Caravati agreed with Ms, Daugherty and said B-1 is essentially transitional <br />zoning between M-I and residential zoning. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Daugherty the ordinance entitled <br />"AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP <br />INCORPORATED IN SECTION 34-15 OF THE ZONING ORDINANCE OF THE <br />CODE OF ~ CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, BY THE <br />REZONING OF CERTAIN PROPERTY LOCATED AT 1308 EAST MARKET <br />STREET" <br /> <br /> Ms. Richards said she feels occupancy of the house is severely stressed and she <br />feels B-1 zoning is appropriate. <br /> <br />PUBLIC HEARING/ORDINANCE: CONVEYING LOT ON EMMET STREET TO <br />UNIVERSITY OF VIRGINIA <br /> <br /> Mr. O'Connell said that during the process of identifying vacant parcels of <br />property in the City, the City staff approached the University of Virginia about selling the <br />narrow strip fronting on Emmet Street, which was leftover from an abandoned road <br />project, to the University. This property is included in the University's master plan. The <br />University agreed to the assessed price and has agreed to provide additional funds to the <br />City for fire service in lieu of taxes. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Richards, the ord'mance entitled <br />"AN ORDINANCE TO AUTHORIZE CONVEYANCE OF CITY-OWNED <br />PROPERTY ON EMMET STREET TO THE UNFv'ERSITY OF VIRGINIA" was <br />offered and carried over to the next meeting for consideration. <br /> <br /> Ms, Richards said it is unusual getting funds in lieu of taxes ~om the University <br />and she feels the proposal is a good way to compensate for the taxes. <br /> <br />ORDINANCE: CLOSING A PORTION OF SADLER STREET <br /> <br /> Mr. Tolbert explained that 1Vlr. Keith Woodard wants to combine the unopened <br />portion of Sadler Street with other property he owns. Mr. Tolbert said the Plann~g <br />Commission recommended closing the street on the condition that a 20 foot easement for <br />utilities be maintained and that the property be sold to Mr. Woodard for the fair market <br /> <br /> <br />
