AN ORDINANCE REGULATING REMOVING PAVEMENTS AND EXCAVATING IN STREETS AND ALLEYS. <br /> <br /> ADOPTED OCTOBER 13, 1904. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL, <br /> <br />(I) . That no person shall take up or remove any portion of pavement or any street <br /> <br />surface or excavate in any street or public alley of the City without written permission <br /> <br />from the Street Commissioner. Such permit must be kept in possession of the doing the work. <br /> <br />No pavement or street surface shall be replaced, after being taken up, by any person <br /> <br />except the Street Commissioner, who shall cause the same to be done and shall make a <br /> <br />bill against the property owner for the actual cost of the work, and give it to the <br /> <br />City Treasurer for collection. Such. bill shall be collected as any otter taxes are <br /> <br />(II). Any person found guilty of taking up any pavement , or street surface , or ___ <br /> <br />in any street or alley in the City without the written permission of the Street <br /> <br />Commissioner,srall be guilty of a misdemeanor and shall pay a fine of not less than <br /> <br />five (5) nor more than ten dollars ($10.00) for each offense. Failure to place gaurd <br /> <br />or barracks around such excavation and to protect it by warning lights at night until <br /> <br />taken in charge by the Street Commissioner shall be deemed a separate offense and shall <br /> <br />be punished by a fine of not less than one dollar ($1.00) nor more than ten dollars <br /> <br />($10.00), each days neglect to constitute a separate offense. <br /> <br />The Superintendent of Water, Gas and Sewers may take up pavements &c. , without <br /> <br />the permission of the Street Comissioner, but shall report the same to the Street <br /> <br />Conriissioner, and protect and guard the same until taken in charge by him. <br /> <br />Presented October 20,1904 Approved October 20, __ <br />Mayor Signature. <br /> <br />AN ORDINANCE REGULATING THE PLANTING OF SHADE TREES IN STREETS. <br /> <br />ADOPTED OCTOBER 12, 1904. <br /> <br />BE IT ORDAINED BY THF CITY COUNCIL, That no person shall plant any shade trees <br /> <br />the streets or sidewalks of the City without the previous consent of the Street ___ <br /> <br />who shall designate tl e proper line for the same. <br /> <br />No North Caroline Poplar, Lombardy Popular Cotton-wood tree shall be planted <br /> <br />the street or alleys of the City, nor within ten feet of the lines of the same. <br /> <br />Any violation of this ordinance shall be punished by a fine of not less than one <br /> <br />dollar ($1.00) nor more than five dollars ($5.00). Neglect or refusal to remove such <br /> <br />trees, as have been planted contrary to this ordinance when ordered to do so by the <br /> <br />shall be a warrant for having the trees removed by the Street Comnissioner, and the <br /> <br />person planting the tree shall pay the cost of the sarne and an additional fine of five <br /> <br />dollars ($5.00). <br /> <br />Presented October 20, 1904. Approved October 20,1904. <br />Mayor Signature. <br /> <br />AN ORDINANCE PROHIBITING THE THROWING OF RINDS AND OTHER SLIPPERY ARTICLES ON SIDEWALKS. <br /> <br />ADOPTED OCTOBER 13M 1904. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL, That no person shall throw upon any sidewalk <br /> <br />or paved street any rind, skin or peeling of any fruit or vegetable, or any other articles <br /> <br />liable to hake a person slip or fall. <br /> <br />For any violation this ordinance the offender shall be fined not less than one <br /> <br />dollar ($1.00) nor more than five dollars ($5.00) for each offense. <br /> <br />Presented October 20, 1904.
