(continued) It shall be unlawful for any person in an intoxicated condition to operate any automobile, motor tricycle or motor bicycle, and, any person so doing shall be liable to a fine of not less than ten dollars nor more than twenty-five dollars, or, in the discretion of the Police Justice thirty days in jail, or both, and said Police Justice shall certify the fact of such conviction to the Mayor who shall thereupon revoke the permit of any person so convicted. BE IT ORDAINED, BY THE COUNCIL OF CHARLOTTESVILLE,That section 264 of the City Code be and is hereby amended and re-enacted to read as follows: SEC. 264. CIRCUSES, EXHIBITION, ETC. It shall be unlawful for any person to make exhibition of a circus, tent of outdoor performance, feats of horsemanship or caravan of animals at any place within the city, unless it be in such a situation as not to disturb or annoy any of the citizens, and unless, in addition, it shall first gave been designated or approve by the Mayor, under a penalty of $20, for each offense; the disturbance or annoyance above Mentioned to be of such character as would constitute a nuisance under the law. Adopted by the Council August 14,1913 Presented and approved August 16 ,1913. President Signature. Mayor Signature. AN ORDINANCE PROVIDING FOR A FUND FOR THE PERPETUAL CARE OF CEMETERIES. SEC. 400-1/2. FUND FOR PERPETUAL CARE OF CEMETERIES. WHEREAS requests have come to this Council from owners of lots and parts of lots in the cemeteries owned and controlled by the City, asking that they be permitted to pair such an amount as would guarantee the perpetual care of their respective sections or parts thereof; and WHEREAS no arrangement for the holding of such funds has ever been perfected by the City; and WHEREAS it is deemed advisable at this time to provide for the reception of such funds on the part of the City for the perpetual care of sections or parts so provided for, therefore be it ORDAINED, BY THE COUNCIL OF CHARLOTTESVILLE: 1st. That there shall be established a fund to be known as "A fund for the perpetual care of sections or parts thereof in the cemeteries, now or hereafter owned or con- trolled by the City of Charlottesville." 2nd. That any owner or other party at interest may deposit with the City Treasurer such sum to provide for the perpetual care of his section or part thereof, as will tit 5% per annurn produce teat amount now required to be paid by owners of sections for the annual care of said sections or parts thereof. That is to say; Owners of whole sections will deposit $160.00 Owners of half sections will deposit 100.00 Owners of quarter sections will deposit 50.00 Owners of eighth sections will deposit 30.00 Owners of grave spaces, per space 20.00 3rd. That such sums so deposited shall be entered upon the ledger of the cite to the credit of the above described fund in the name of the party paying the same, and shall so stand to the credit of said account as long as this arrangement may be, in effect. 4th. That the City shall keep such sections or parts thereof as shall have been deposited for, in good condition, that is to say; they shall be kept in good sod, the grass shall be kept trimmed and in good appearance and the gave stones shall be kept in shape, except that the city shall not be held liable for the deterioration of the stones or markers caused by the erosion of the elements. 5th. Should the City, at any time, discontinue the control and supervision of the several cemeteries then such funds ahall be transmitted to its successors, or returned to the estates pairing such sums into said fund. 6th. The City Auditor shall, annually on the last day of the fiscal year, set over to the credit of the Cemetery account such intersst as may have accrued at the rate of 5%, a per annum on the sums so deposited.
