An Ordinance providing for proper disposal of human excreta in the City of

<br />Charlottesville and prescribing construction, maintenance, scavenging and inspection
<br />
<br />of privies, etc.
<br />
<br />Be it Ordained by the Board of Aldermen, the Cummon Council concurring, That
<br />
<br />1. It shall be unlawful for any property holder or his authorized agent to permit
<br />
<br />upon any of his property in Charlottesville a privy or dry closet of any kind or
<br />
<br />description, for the reception of human excreta, to be maintained or to exist
<br />
<br />where any of the improvements of said prohfrty are connected with a public sewer
<br />
<br />of said city or located on a street, along which runs a public sewer.
<br />
<br />2. It shall be unlawful for any person in Charlottesville to throw out, deposit
<br />
<br />or bury within the city limits, any excreta from human bodies, solid or liquid, or to
<br />
<br />dispose of such substance in any manner other than a properly sewered water closet
<br />
<br />or properly constructed sanitary privy.
<br />
<br />3. All buildings or other places in said city where human beings live, are employed
<br />
<br />or congregate shall be provided with a sewered water closet or a sanitary privy for
<br />
<br />the catchment, or receiving of hunan discharges which will properly dispose of any
<br />
<br />safeguard such matter.
<br />
<br />4. It shall be unlawful for any property owner or his authorized agent or tenant
<br />
<br />to construct, maintain or permit to exist on any property or properties under his
<br />
<br />control where a sewer connection has not been made, a privy unless the same be
<br />
<br />sanitary, or is constructed as provided hereinbelow.
<br />
<br />5. A sanitary privy is one so built, rebuilt or constructed that (a) the excreta
<br />
<br />depoisted therein will not fall upon the ground but in some water -tight receptacle
<br />
<br />and (b) the contents of which receptacle sllsiall not be accessible to flies,fowls
<br />
<br />or small animals at any time. (c) The box parts of said privy shall be constructed
<br />
<br />of sound lumber., all joints being made tight. Said box is to be provided with a
<br />
<br />lid closely fitting, and the seat thereon is to be provided with, a hinged lid _
<br />
<br />to render such box fly -proof. (d) proper ventilation of such box shall be provided
<br />
<br />by means of suitable placed openings and a flue. Such ventilation openings are to be
<br />
<br />screened with a good Trade 14 meet wire screening. (e) Such privies shall be located
<br />
<br />as to be easily accessible to the scavenger for cleaning.
<br />
<br />6. The Board of wealth of Charlottesville shall prescribe by revulations proper
<br />
<br />sizes and methods of conbtruction of such privies, and such other details as will
<br />
<br />render this ordinance effective and its application uniform. All such, privies must
<br />
<br />conform to such, regulations.
<br />
<br />7. The contents of all privy receptacles shall be removed by the city scavenger.
<br />
<br />Such, removing and cleaning shall be done under the supervision of the City wealth
<br />
<br />Officer and for such services the following charges shall be made:--
<br />
<br />For cleaning each privy at private homes one dollar and fifty cents (1.50)
<br />
<br />per quarter in advance, if excreta is removed oftener than three times in a month
<br />
<br />there shall be an additional charge of thrity cents (.30 ) for each removal
<br />
<br />The fees charges set out in this section shall be paid at the office of
<br />
<br />the City Treasurer at the beginning of each quarter, provided, however, that an
<br />
<br />addition of fifty cents (.50) shall. be made to the above charges if same are not
<br />
<br />paid within the first ten days of each quarter.
<br />
<br />8. All sanitary privies in said city shall be kept in a cleanly condition at all
<br />
<br />times and so used that all excreta deposited herein will fall into the receptacle
<br />
<br />provided. Such receptacle shall be used inly for the purpose of a toilet, and no
<br />
<br />wash water, garbage, or other refuse matter other than human excreta shall be
<br />
<br />depositid therein. No deodorant or disinfectant such as lime shall be used if any
<br />
<br />injury to the cans is caused by its use.
<br />
<br />9. No privy receptacle shall be permitted to become filled to overflowing.
<br />
<br />If emptying of the privy receptacles becomes necessary oftener than provided for for
<br />
<br />it shall be the duty of the occupant of the property to nofify the City Health Officer
<br />
<br />who sall determine the cause for such necessity and force its correction.
<br />
<br />10. All privies existing or maintained in said City after the date on which this
<br />
<br />ordinance takes effect, which do not comply with the requirements of this ordinance
<br />
<br />or the regulations issued under this ordinance, shall be and are hereby dec-
<br />
<br />a nuisance, dangerous to the public health, and the City of Charlottesville shall
<br />
<br />proceed to abate such nuisance in accordanc a with law or the ordinance of said city.
<br />
<br />11. The City, through their Board of Health shall have the further right to make
<br />
<br />or cause to be made such alterations or constructions to such privies as are found
<br />
<br />to be nuisances, that will render them sanitary, and the entire cost of such work
<br />
<br />shall be charged against the owner of the property. All such alterations or
<br />
<br />constructions are prescribed and approved by the Board of Health.
<br />
<br />12. All houses having a sewer which discharges into a septic tank or cesspool shall
<br />
<br />be provided with an ample and approved subsurface distribution system to care for
<br />
<br />the effluent from such tank or cesspool. Persons desiring to have sewer connections
<br />
<br />in their homes where no sewer exists with which to connect, may be allowed to construct
<br />
<br />a septic tank provided the same is of proper size and construction and
<br />
<br />with an ample sub -surface distribution system. The requirements as to size,
<br />
<br />contruction and sub -surface distrtribution shall be governed by regulations of the
<br />
<br />Board of Health, and, in each case, approved by said Board.
<br />
<br />13. All receptacles for sanitary privies in Charlottesville shall be in the beginning
<br />
<br />be furnished by the properLy owner. Said receptacle shall be interchangeable from
<br />
<br />closet to closet and replacement of destroyed or worn receptacles is to made by the
<br />
<br />city or by the scavenger if provided fur by contract. It shall be unlawful
<br />
<br />person to take, destroy, misuse or misplace any such receptacle.
