SOMET IMLS CALLED 6TH STREET S E. BETWEEN EAST <br />AN ORDINANCE CLOSING 51H STREET, S. E. � S. <br />WATER STREET AND EAST SOUTH STREET, SO FAR AS THE SAME HAS NOT ALL RL;ADY BEEN CLOSED; <br />THE PROPERTY TO FEVERT TO THE ABUTTING LATJD OWNERS ON TH.& EAST AND WEST. <br />VW1i.&REAS under subsection first, Section 13 of the Charter of the City <br />of the City of Charlottesville, Chapter 411, Virginia Acts, 1922 the Council of the <br />City of Charlottesville is authorized to close streets in said city, and whereas it <br />is provided in said subsection o_t said Charter that "The land included in any street <br />that is closed shall revert to the abutting owners of either side of the same, each <br />receiving, one-half thereof. That is, the new line oieach abutter shall be the middle <br />of the for.iier street," and <br />W,iEREAS by Acts of General Assembly of 1904, Chapter 96, p 136, approved <br />I14Iarch 10th, 1904 and also by action of the City Council in 1904, Minute Book 4, page 140 <br />and 141nute B)ok 4, p 145, 5th Street, S. E., sometimes called 6th Street, S. E. was <br />closed so far as the sane is occupied by the right of way of the Chesapeake & Ohio <br />.ailway Compaliy, and <br />''REAS by closing said Street near the middle of the block between <br />F4st South Street and East .'tater Street the Street is rendered useless between East <br />South Street and East 'Nater Street to all persons excepting those abutting thereon, and <br />WHEREAS the lv;ichie Grocery Company, Incorporated, Charles King & Son <br />Company, Incorporated and the 0izesapeake & Ohio Railway Company and ramie Falwell are <br />the only persons owning property on 5th Street S. E. Between East South Street and <br />East Water Street, and <br />WH&EAS the Michie Grocery Company, Incorporated, Charles King & Son <br />Company, Incorporated* I orated, the Chesapeake & Ohio F.ailway and Mamie Falwell have petitioned <br />the IAor and the Council of 'the City of Charlottesville to clo:�e said Street and to <br />p I� y <br />cause ro - <br />the rt therein to revert to the abutting land owners on the east and west <br />of said Street. <br />NOW THEREFORE BE IT ORDAINED By the Council oi, the City of Charlottes- <br />ville that 5th Street S. E. between East South ,street and Last Water street be and the <br />same is hereby <br />forever closed and abandoned as a street and the land included in the <br />said Street herebyclosed shall revert to the abutting owners on either side of the same, <br />vin one-half thereof , that is the new line of each abutter stlall be the <br />each receiving <br />middle of the former street. <br />Adopted by the Council March 19, 1925. <br />Ayes, Brown and Joachim, Noes None. <br />P.. <br />n05 <br />
