90 <br /> <br />THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1990, AS AMENDED" was offered <br />and carried over to the next meeting for consideration. <br />RESOLUTION: VDOT PROGRAMMING FOR INTERSECTION OF MCINTIRE <br />ROAD AND 250 BYPASS <br /> Mr. O'Connell presented an amended resolution proposed by Mr. Cox which <br />would restrict the resolution to preliminary study and preliminary engineering of the <br />intersection. <br /> <br /> Ms. Richards said that seems redundant. <br /> <br /> Mr. Cox said that when we talk about reimbursement it is important to talk about <br />direct consultant costs, not VDOT costs, and suggested that "direct consultant cost," not <br />total costs expended by VDOT be put into the resolution. <br /> Ms. Judith Mueller, Director of Public Works, said that she can see ifVDOT staff <br />will take this language to the Commonwealth Transportation Board. Ms. Mueller said <br />she does not know if all VDOT staff are charged for work on such a project. Ms. Mueller <br />said the scope of work is expected to cost $67,000 and urban road funds may be able to <br />be used. <br /> <br /> Mr. Lynch said he agrees the language could be tightened up. <br /> <br /> Mr. Lynch moved the resolution, amended to change the last sentence to "total <br />amount of contractor expenses expended by the department." <br /> <br /> Mr. Cox seconded the motion and said he thinks this clarifies the role of VDOT. <br /> <br /> Mr. Caravati said the role ofVDOT at this stage w411 be minimal, and he does not <br />think the amendment is particularly relevant. <br /> <br /> Ms. Richards noted that the consultant will require a certain amount of <br />information and data from VDOT. <br /> <br /> Mr. Lynch's motion was denied by the following vote. Ayes: Mr. Lynch. Noes: <br />Mr. Caravati, Mr. Cox, Ms. Richards, Mr. Toscano. <br /> <br /> Mr. Toscano made a motion to approve the resolution presented at the meeting <br />which proposes programming for preliminary study and preliminary engineering of the <br />intersection. Mr. Lynch seconded the motion and it was approved by the following vote. <br />Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: Mr. Cox. <br /> <br /> WltEREAS, in accordance with Virginia Department of Transportation <br />construction allocation procedures, it is necessary that a request by Council resolution be <br />made in order that the Department program an urban highway project in the City of <br />Charlottesville; now <br /> <br /> TItEREFORE BE IT RESOLVED, that the Council of the City of <br />Charlottesville, Virginia requests the Virginia Department of Transportation to establish <br />an urban system highway project for the Intersection of Mclntire Road, Meadowcreek <br />Parkway and the Route 250 Bypass. <br /> <br /> BE IT FURTltER RESOLVED, that the Council of the City of Charlottesville <br />hereby agrees to pay its share of the total cost for preliminary study and preliminary <br />engineering of this project in accordance with Section 33.1-44 of the Code of Virginia, <br />and that, if the City of Charlottesville subsequently elects to cancel this project, the City <br />of Charlottesville hereby agrees to reimburse the Virginia Department of Transportation <br />for the total amount of the costs expended by the Department through the date the <br />Department is notified of such cancellation. <br /> <br /> <br />
