137 <br /> <br /> On motion by Ms. Richards, seconded by Mr. Lynch, the resolution accepting the <br />National Ground Intelligence Center building was approved by the following vote. Ayes: <br />Ivlr. Caravati, Mr. Lynch, Ms. Richards. Noes: None. Absent: Mr. Cox and Mr. <br />Toscano. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />the City hereby accepts from the United States government all right, title and interest in <br />and to a parcel of real property, including any improvements thereon, located on 7th <br />Street and East Jefferson Street, formerly occupied by the National Ground Intelligence <br />Center (the "Property"). Pursuant to the requirements of Public Law 106-398 (copy <br />attached), the Property: <br /> <br />1. Shall be conveyed to the City without consideration; <br /> <br />Shall revert to the United States if the Property is not used for economic <br />development purposes during the five year period after conveyance to the <br />City; and <br /> <br />Shall be subject to the limitations on subsequent conveyances imposed by <br />Public Law 106-398, including payment by the City of the Property's fair <br />market value if conveyed to a private entity. <br /> <br /> The Mayor is hereby authorized to execute a deed of conveyance, in form <br />approved by the City Attorney, and the City Attorney and Director of Economic <br />Development are hereby directed to take whatever steps are necessary to effect the <br />above-described conveyance. <br /> <br />PUBLIC HEARING: MOVING JEFFERSON PARK AVENUE POLLING PLACE <br />ORDINANCE TO FRY'S SPRING BEACH CLUB <br /> <br /> Mr. O'Connell explained that the Electoral Board has been looking at alternate <br />sites to replace the voting precinct at Jefferson Park Baptist Church, and recommends <br />Fry's Spring Beach Club. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Responding to a question from Mr. Lynch, Ms. Cheri Lewis, Chair of the <br />Electoral Board, said that while no long term commitment has been made for the precinct <br />to remain at Fry's Spring Beach Club, representatives of the Beach Club have been <br />amazing receptive to it being there and she does not foresee any potential conflict. <br /> <br /> Ms. Richards asked if it is customary to place signage directing voters to the new <br />site, and Ms. Lewis said the Board is required by law to notify all voters by mail of the <br />precinct change and they will also put up signs. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING SECTIONS 9-27 AND 9-29 OF <br />ARTICLE II OF CHAP ~TER 9 OF ~ CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO A CHANGE IN THE <br />LOCATION OF THE JEFFERSON PARK PRECINCT POLLING PLACE" was offered <br />and carried over to the next meeting for consideration. <br /> <br />~SOLUTION: AUTHORIZING PURCHASE OF PROPERTY ON AVON <br />APPROPRIATION STREET EXTENDED; $585,00 - PURCHASE OF AVON <br /> STREET EXTENDED PROPERTY (2nd reading) <br /> <br /> Ms. Judy Mueller, Director of Public Works, said that the City currently owns 50 <br />acres of land on Avon Street Extended. As a result of interest in future uses of the <br />current City Yard on 4th Street, staffrecommends purchasing three acres of land which is <br />adjacent to the land akeady owned on Avon Street Extended for future development. Ms. <br />Mueller said staff has a statement from Albemarle County that the proposed use of the <br /> <br /> <br />
