159 <br /> <br /> Mr. Lynch said he feels that if the ordinance is adopted it should be applied to <br />residences and businesses on the downtown mall. Mr. Lynch said he thinks 10:00 p.m. is <br />too early for weekends and should be made later, perhaps midnight, or 1:00 a.m. and the <br />morning time should be moved to 7:00 p.m. <br /> <br /> Mr. Brown said hours that the noise ordinance is in effect can be changed and the <br />ordinance could be revised to include noise from within buildings. <br /> <br /> Mr. Toscano agreed that the ordinance should apply starting at midnight on <br />weekends. <br /> <br /> Mr. Cox said he agrees with changing the time, and while he shares the concerns <br />about noise generated from within buildings, he would prefer to amend the ordinance at a <br />later time rather than fold it in now. Mr. Cox made a motion to approve the ordinance <br />with the time changed to midnight on Friday and Saturday nights. Mr. Toscano seconded <br />the motion and the ordinance entitled "AN ORDIN,adNCE TO AMEND AND <br />REORDAIN SECTION 16-3 (DEFINITIONS) OF CHAPTER 16 (NOISE CONTROL) <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />AND TO FURTHER AMEND CHAPTER 16 BY ADDING THERETO NEW <br />SECTIONS 16-10 (SOUND LEVELS - DOWNTOWN MALL) AND 16-11 (SOUND <br />LEVEL MEASUREMENT" was offered and carried over to the next meeting for <br />consideration. <br /> <br /> Ms. Richards said there are also issues with buildings who have internal <br />neighbors. <br /> <br /> Mr. Caravati suggested that staff could negotiate with restaurants that have caf6 <br />permits. <br /> <br /> Mr. Cox said that there has been a good response of residents to be involved in <br />developing the code of conduct, but a full spectrum of musicians is needed. <br /> <br />CONSENT AGENDA <br /> <br />Mr. Caravati removed the permit parking ordinance from the consent agenda. <br /> <br /> On motion by Mr. Cox, seconded by Mr. Toscano, the following consent agenda <br />Rems were approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, <br />Ms. Richards, Mr. Toscano. Noes: None. <br /> <br />a. Minutes of August 20 <br /> <br />b. APPROPRIATION: <br /> <br />$50,574 - Transfer of Community Assistance <br />Program Funds to WorkSource Enterprises <br />(2nd reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that <br />the sum of $50,574, previously appropriated for FY 02 to MACAA (Monticello Area <br />Community Action Agency), is hereby appropriated from expenditure accounts 05-302- <br />062048-53119 ($29,125) and 05-301-062015-54112 ($21,449) to expenditure account <br />05-301-62164 for the purpose offimding the City's share of the Community Assistance <br />Program which will be operated by WorkSource Enterprises beginning July 1, 2001. <br />This fimding modification is the result ora change in program sponsorship as agreed to <br />by MACAA and WorkSource Enterprises. <br /> <br />c. APPROPRIATION: <br /> <br />$5,000 - Virginia Commission of the Arts <br /> Challenge Grant (for Piedmont council of the Arts <br />And Virginia Discovery Museum) (2nd reading) <br /> <br /> WHEREAS, the Virginia Commission for the Arts has notified the City of its <br />grant award in the Local Government Challenge Grant category; now, therefore, <br /> <br /> <br />
