Ms. Richards said she believes there will also be some <br />spotty raised medians. Ms. Richards noted that a task force did not support four lanes <br />and the three lanes were to facilitate turning only. <br /> <br /> Ms. Richards made a motion to approve the resolution approving the design of the <br />Fontaine Avenue project, and Mr. Toscano seconded the motion. <br /> <br /> Mr. Caravati said he will begrudgingly support the resolution, noting that he is <br />worded about the study of area B and that we may have to go back and backtrack. <br /> <br /> The resolution approving the design of the Fontaine Avenue project was approved <br />by the following vote. Ayes: Mr. Caravati, Ms. Richards, Mr. Toscano. Noes: Mr. Cox <br />and Mr. Lynch. <br /> <br /> WHEREAS, a Location and Design Public Hearing was conducted on January <br />27, 2000 in the City of Charlottesville by representatives of the Commonwealth of <br />Virginia, Department of Transportation after due and proper notice for the purpose of <br />considering the proposed location and design of the Fontaine Avenue Project 7029-104- <br />V03~ C-501 in the City of Charlottesville at which hearing aerial photographs, drawings <br />and other pertinent information were made available for public inspection in accordance <br />with state and federal requirements; and <br /> <br /> WHEREAS, all persons and parties in attendance were afforded full oppommity <br />to participate in said public hearing; and <br /> <br /> WHEREAS, representatives of the City of Charlottesville, were present and <br />participated in said Hearing; and <br /> <br /> WItEREAS, the Council had previously requested the Virginia Department of <br />Transportation to program this project; and <br /> <br />WHEREAS, the Cotmcil considered all such matters; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City of <br />Charlottesville hereby approves the location and major design features of the proposed <br />project as presented at the Public Hearing; and <br /> <br /> BE IT FURTHER RESOLVED, that the City of Charlottesville requests the <br />Virginia Department of Transportation to acquire all rights of way necessary for the <br />project in the name of the Commonwealth of Virginia at the appropriate time. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute, on behalf of the City of Charlottesville all necessary railroad and utility <br />agreements required in conjunction with acquiring such rights of way. <br /> <br />ORDIN3uNCE: IMPOSING LEASH LAW FOR DOG SIN CITY PARKS (2nd reading) <br /> <br /> Ms. Judy Mueller, Director of Public Works, said that Council had directed staff <br />to come back with a pilot shared time for Riverview Park. A meeting was held on <br />December 1 lth with neighborhood representatives, dog owners, police and staff, and an <br />area was identified for off-leash (the initial loop of the Greenbelt), not to be fenced, for <br />Tuesdays, Wednesday, and Thursdays. There was agreement that the interested parties <br />will meet during the six month pilot period to help make the shared time a success. Ms. <br />Mueller said this was clearly a compromise. <br /> <br /> Mr. Craig Brown, City Attorney, said that the ordinance was offered on first <br />reading to include the shared time, and it has been further requested that dogs be required <br />to be on leash in City owned cemeteries. <br /> <br /> Ms. Richards asked if iris usual to have a public hearing when an ordinance is <br />changed, and Mr. Brown said there is not one way that he would call customary, but said <br />a public hearing is not legally required. <br /> <br /> <br />
