He said he does not like the idea of a co-pay, but feels we should try to get <br />the funds from VDOT. <br /> <br /> Ms. Richards said she thinks it is okay for the CRy to pick up the cost, and thinks <br />that eventually we will get it from VDOT. <br /> <br /> It was the consensus of Cotmci! to make the streets which are smaller than <br />VDOT's standards public streets. <br /> <br />RESOLUTION: EXTENSION OF 2001 OUTDOOR CAF]~ PERMITS <br /> <br /> On motion by Ms. Richards, seconded by Mr. Toscano, the resolution extending <br />existing outdoor card permits for three months was approved by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None, <br /> <br /> WHEREAS, City staff is currently studying the annual process by which <br />applications for the use ofpubtic sidewalks and the dovaatown mall as outdoor cafd areas <br />are reviewed and granted; and <br /> <br /> WHEREAS, staffrecommendations for revisions to this process, as well as the <br />ordinances set forth in Chapter 28 of the City Code, are expected to be completed in time <br />to be considered by City Council in March 2002; and <br /> <br /> WHEREAS, the outdoor caf6 permits granted for the 2001 caf6 season were set <br />to expire on November 30, 2001, but were extended by previous resolution of this <br />Council through December 31, 2001; and <br /> <br /> WHEREAS, at this time Council desires to extend all existing permits to allow <br />permit holders who desire to do so to continue operating through the winter months, <br />subject to the agreement of such permit holders tob e responsible for the costs of <br />removing any ice and snow which may accumulate within their outdoor card areas during <br />the extended period of time; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that all existing outdoor caf6 <br />permits issued by the City pursuant to Chapter 28, Article VI, Division 2 of the City <br />Code, valid for the period of March 1, 2001 through December 31, 2001 are hereby <br />extended, and shall remain in effect, throngh March, 2002. No new permits shall be <br />issued by the City for the period of January 1, 2002 through March 31, 2002. <br /> <br /> BE IT FURTHER RESOLVED that during the period of this extension, it shall <br />be a condition of the extended permit that each permit holder who chooses to continue <br />operations shall be responsible for keeping his caf6 area free and clear of ice and snow, <br />and that the operator shall post a bond in the amount of five hundred dollars ($500.00) to <br />guarantee this obligation. If the operator fails to meet this obligation and the City must <br />act to clear the area, then the permit holder shall he required to reimburse the City for any <br />costs incurred for such removal (such costs payable by the operator), and the City may <br />revoke the caf6 operator's permit. <br /> <br />CONSENT AGENDA <br /> <br /> Mr. Lynch removed the resolution and appropriate of the $2,500,000 Loan to <br />CIDA from the consent agenda. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, the following consent agenda <br />Rems were approved by the following vote.
