STAFF REPORT RE: <br />OBTAINING FINANCIAL <br />ADVISOR <br /> <br /> VOTE AGAINST THE RESOLUTION, BECAUSE HE DISAGREED WITH USING TAX <br /> EXEMPTION AS A PUBLIC SUBSIDY. HE FELT THAT SUCH A REQUEST SHOULD BE <br /> WEIGHED AGAINST OTHER REQUESTS FOR PUBLIC SUBSIDY THROUGH THE BUDGETARY <br /> <br /> PROCESS AND CI.TED PAY FOR TEACHERS AS AN EXAMPLE. MR. CONOMER STATED <br /> THAT ALTHOUGH HE WOULD VOTE NO, HE FULLY SUPPORTS THE ORGANIZATION'S <br /> EFFORTS. <br /> MRS. GLEASON ASKED IF GRANTING THE TAX EXEMPT STATUS WOULD BE A <br /> <br /> PERMANENT ACT? <br /> <br /> MR2 WILEY RESPONDED, INDICATING THAT THE GENERAL ASSEMBLY COULD <br /> <br /> REPEAL THE EXEMPTION, BUT THAT HE HAS NEVER KNOWN THEM TD DO SO. HE <br /> <br /> STATED THAT IF IT WAS FELT THE ORGANIZATION HAD LOST ITS CHARITABLE <br /> <br /> PURPOSE, THAT WOULD CONSTITUTE GROUNDS FOR RECONSIDERATION. <br /> <br /> DR. HALL RESTATED HIS POSITION, SAYING THAT HE DOES NOT SEE <br /> <br />THE PROGRAM AS BEING A BURDEN TO THE CITY, BUT A SERVICE TO THE CITY. <br />HE FELT THAT IT WOULD BE AN INJUSTICE IF COUNCIL WERE TO TURN DOWN THE <br />REQUEST. <br /> MR. HAS BEEN ESTABLISHED <br />AS A NON-STOCK, NON-PROFIT CORPORATION TO FULFILL THE CHARITABLE AND <br />BENEVOLENT OBJECTIVE OF PROVIDING HOUSING FOR FAMILIES OF CHILDREN <br />RECEIVING MEDICAL TREATMENT AT THE UNIVERSITY OF VIRGINIA MEDICAL CENTER~ <br />AND <br /> <br /> WHEREAS, THE COUNCIL FINDS THAT HEARTHSTONE CHILDRENS' HOUSE, INC: <br /> <br /> IS EXEMPT FROM FEDERAL TAXATION PURSUANT TO SECTION <br /> 501(C) OF THE ~NTERNAL REVENUE CODE OF 1954s <br /> <br /> 2) HOLDS NO CURRENT[LICENSE FROM THE ALCOHOLIC BEVERAGE CONTROL <br /> BOARD~ <br /> <br /> 3) PAYS NO COMPENSATION TO ANY OFFICER OR DIRECTOR IN EXCESS <br /> OF REASONABLE ALLOWANCE FOR SERVICES RENDEREDI <br /> <br /> DOES NOT DISTRIBUTE ANY PART OF ITS NET EARNINGS TO <br /> ANY INDIVIDUAL AND GENERATES A SUBSTANTIAL PART DF <br /> ITS FUNDS FROM PRIVATE DONATIONS~ <br /> <br /> 5) PROVIDES SERVICES FOR THE COMMON GOOD OF THE PUBLICs <br /> <br /> 6) DOES NOT CARRY ON SUBSTANTIAL ACTIVITIES TO INFLUENCE <br /> LEGISLATION OR POLITICAL CAMPAIGNS~ AND <br /> <br /> 7) HAS NO RULE, REGULATION, POLICY DR PRACTICE <br /> DISCRIMINATING ON THE BASIS OF RELIGION, RACE, COLOR, SEX OR <br /> NATIONAL ORIGINs <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />CHARLOTTESVILLE THAT THE COUNCIL DOES HEREBY ENDORSE, SUPPORT AND <br />APPROVE HOUSE BILL 349 EXEMPTING PROPERTY OF HEARTHSTONE CHILDRENS' <br />HOUSE, INC. FROM STATE AND LOCAL TAXATION. <br /> <br /> ROBERT SHEETS, DIRECTOR OF FINANCE REPORTED THAT SINCE THE CITY <br /> <br />IS ABOUT TO EMBARK ON FOUR CAPITAL PROJECTS WITHIN THE NEXT EIGHTEEN <br />MONTHS, WITH AN EXPENDITURE OF APPROXIMATELY $5,000,000.00, HE PROPOSES <br />THAT A FINANCIAL ADVISOR BE OBTAINED BY THE CITY. MR. SHEETS RECOMMENDED <br />THE FIRM OF HORNER, BARKSDALE AND ASSOCIATES OF LYNCHBURG. HE STATED <br />THAT THE FIRM WOULD WORK WITH THE CITY STAFF IN PREPARING THE OFFICIAL <br />STATEMENT, PROVIDE SPECIAL CONSULTATION IN ALL RELATIVE ISSUES <br />CONCERNING THE SALE OF THE BOND ANTICIPATION NOTES, AND ENHANCE <br />MARKETABILITY OF THE CITY'S BONDS AND NOTES BY DAY-TO-DAY CONTACT WITH <br />INSTITUTIONAL AND INDIVIDUAL BUYERS.
