<br /> A copy of such document shall be kept on file with the minutes of
<br />the Council meeting at which this resolution was adopted.
<br />
<br />On motion by Mrs. Gleason, seconded by Dr. Hall, the following resolution
<br />
<br />was adopted by the following vote. Ayes: Mr. Buck, Mr. Conover, Mrs.
<br />
<br />Gleason, Dr. Gunter, Dr. Hall. Noes: None.
<br />
<br /> BE IT RESOLVED by the Council of the City of Charlottesville that
<br />the City hereby grants to the Rivanna Water and Sewer Authority, a
<br />political subdivision of the Commonwealth of Virginia, a permit to
<br />accomplish the following project and such permit ~s subject to the
<br />conditions herein stated:
<br />
<br /> (1) The Rivanna Water and Sewer Authority, hereinafter referred
<br />to as the Authority, is granted permission to install, operate, maintain,
<br />and repair a water transmission line in and across a certain parcel of
<br />real estate in Albemarle County owned by the City and known as Pen Park.
<br />The center line Of said water line is as shown on a plat prepared by
<br />Thomas D. Blue, C.L.S., annexed hereunto and make a plat hereof. The
<br />area construction is shaded in red on said plat. In addition, during the
<br />installation of said water line, the Authority or its contractor is
<br />authorized to utilize an additional area on either side of the construction
<br />area to facilitate construction; such area being shaded in blue.
<br />
<br /> (2) The following restrictions are hereby imposed on the Authority
<br />in its use of this permit:
<br />
<br />A. Prior to the initiation of work, the City, through
<br />its Director of the Department of Parks and Recreation,
<br />in conjunction with representatives of the Authority
<br />and its consulting engineer and contractor, will identify
<br />certain valuable trees and other plants within the area
<br />shaded in blue which shall be selected for preservation,
<br />and such trees or plants will be clearly marked. It is
<br />understood that the area shaded in red will be clear-cut.
<br />
<br />B. The Director of the Department of Parks and Recreation
<br />will also identify any unique microecosystems within the
<br />area shaded in blue which should be preserved, if possible.
<br />
<br />C. The Authority will restore any structures and drainage
<br />facilities damaged or destroyed during construction.
<br />
<br />D. The area disturbed by construction shall be restored
<br />to the extent possible to its pre-construction grade, and
<br />the area shall be reseeded and/or reforrested using the
<br />plant species that shall be as mutually agreed between the
<br />Director aforesaid and the Authority.
<br />
<br />E. Upon completion of all work in the area, the line will
<br />be inspected by a representative of the Virginia Commission
<br />of Outdoor Recreation to ensure that conformity with the
<br />plans and specifications and the terms of this permit.
<br />
<br /> This permit shall remain in full force and effect so long as the
<br />Authority operates and maintains said water line.
<br />
<br />On motion by Mr. Conover, seconded by Dr. Hall, the following
<br />
<br />resolution was adopted by the following vote. Ayes: Mr. Buck, Mr.
<br />
<br />ConOver, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None.
<br />
<br /> WHEREAS, the Council of the City of Charlottesville, Virginia (the
<br />"Council"), has created the Industrial Development Authority of the City
<br />of Charlottesville, Virginia (~he "Authority"), pursuant to the Virginia
<br />Industrial Development and Revenue Bond Act to fulfill the purposes of
<br />such act; and
<br />
<br /> WHEREAS, the ordinance adopted by the Council on July 19, 1976, as
<br />amended on February 3, 1980, which created the Authority (the "Ordinance"),
<br />provides that the Authority shall not finance any facility until the
<br />location and financing of such facility have been approved by the Council;
<br />and
<br />
<br /> WHEREAS, Section 5 of the ordinance sets forth certain standards to
<br />be considered by the Authority and the Council in determining the nature
<br />and location of facilities to be financed by the authority; and
<br />
<br /> WHEREAS, the Authority on , 1982 adopted an inducement
<br />resolution agreeing to assist Michael Simpson and C. Bernard Martin,
<br />trading as Simpson/Martin, or an entity to be formed by them (the
<br />"Reveloper"), in the financing of the acquisition, renovation, construction
<br />and equipping Of a retail sales, general commercial and office facility
<br />to be located in the City' of Charlottesville, Virginia (the "Project"), by
<br />the issuance of the Authority's Industrial Development Revenue Bonds in
<br />an amount not to exceed $300,000; and
<br />
<br /> WHEREAS, preliminary plans for the Project and the financing have
<br />been described to the Council in a presentation by the developer; and
<br />
<br /> WHEREAS, the Project will be located at 105 West Main Street in the
<br />City of Charlottesville, Virginia.
