ORDINANCE: <br />AMENDMENTS TO <br />ZONING ORDINANCE <br />(2nd reading) <br /> <br />ORDINANCE: <br />AMENDMENTS TO <br />Z~ONING ORDINANCE <br /> <br /> Mr. Buck stated that this procedure is wise and asked if there is <br /> <br /> any assurance that the risk the City is accepting is reasonable since this <br /> is a source of major liabflity and financial responsibility. <br /> <br /> Mr. Berberich, Director of Public Works, responded, stating that <br /> <br /> since the development is well designed, he could foresee no difficulties. <br /> <br /> Mrs. Gleason asked about protection for children (a fence) around the <br /> ponds. <br /> <br /> Mr. Berberich stated that fences are not needed because the water is <br /> only in the ponds du~ing a storm. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the following <br /> resolutinn was approved by the following vote. Ayes: Mr. Buck, Mrs. <br /> Gleason, Dr. Gunter, Dr. Hall. Noes: None. Absent: Mr. Conover. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, that the <br /> Mayor is hereby authorized to execute on behalf of the City the following <br /> document, in form approved by the City Attorney: <br /> <br /> Deed of Dedication and Acceptance between Seminole Square <br /> and the City of CHarlottesville for drainage and retention <br /> facilities located in the Seminole Square Subdivision. <br /> <br /> A copy of such document shall be kept on file with the minutes of the <br /> Council meeting at which this resolution was adopted. <br /> <br /> Mrs. Gleason addressed the problem of hotels not being able to have <br /> electronic video game rooms available to their guests because of this <br /> ordinance. She stated that the groups of machines are not a problem, but <br /> the undesirable, large groups of people which accumulate around such an <br /> establishment. Mrs. Gleason suggested the ordinance be amended"so that <br /> hotels are not included in the prbhibition. <br /> <br /> Mrs. Gleason moved to amend the ordinance as stated above. The motion <br /> was seconded by Dr. Gunter and COuncil voted as follows. Ayes: Mr. Buck, <br /> <br /> Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. Absent: Mr. Conover. <br /> <br /> Mr. Buck referred to the section of the ordinance which would allow <br /> <br />notification of zoning changes by first class mail. He stated that the <br />Planning Commission had discussed whether the City should continue with <br />present registered letters to adjacent property owners or should change <br />its ordinance to notify adjacent property owners with a regular letter <br />(with an affidavit certifying that the letters were sent). Mr. Buck stated <br />that the Planning Commission felt the affidavit procedure is as verifiable <br />as registered mail in terms of proving that letters were sent. He stated <br />that the Planning Commission could not see any logical reason why it is <br />necessary to use registered mail and that sending registered letters could <br />still be done in certain situations where assurance of receipt is absolutely <br />necessary. <br /> <br /> Dr. Gunter suggested an in-house policy as opposed to amending the <br />ordinance. <br /> <br /> Mr. Wiley reviewed the ordinance. <br /> <br /> Mr. Buck stated that the Jefferson Park Avenue Neighborhood Association <br />had suggested changes in the ordinance relating to the number of parking <br />spaces for multiple dwellings. <br /> <br /> Dr. Gunter stated that the suggestion was reasonable and made a motion <br />to amend the ordinance as follows: It spaces for each unit with one or two <br />bedrooms and ~ additional space for each bedroom or room usable as a bedroom <br />in excess of two per unit.
