195 <br /> <br />HOUSING ASSISTANCE <br />PLAN <br /> <br />RESOLUTION: <br />AUTHORIZING MAYOR <br />TO SIGN DEED OF <br />RESTRICTION ON <br />609 BROWN STREET <br />(CITY YARD) <br /> <br />RESOLUTION: <br />RESTRICTING ACCESS <br />TO BROWN STREET <br />FROM CITY YARD <br /> <br />Dr. Gunter questioned the current zoning of the property and what <br /> <br />it would be used for in the future. <br /> Mr. Conover indicated that he also had concern for the zoning of <br />the property, specifically, that the use by Region Ten may have been <br />more intensive than surrounding orooerties. <br /> <br /> Mr. Hendrix recommended that Mr. James Peterson, Executive Director <br />of Region Ten Community Services Board, be contacted to address Council <br />on their concerns at the next scheduled meeting. <br /> <br />Mr. Glenn Larson, Planner II of the Department of Communuty <br />Development, reported to the Council on the City's Housing Assistance <br /> <br />Plan. <br /> <br /> Mr. Conover suggested that the Housing Assistance Goals for the <br /> <br />City should be based on surrounding jurisdictions meeting the needs for <br />subsidized housing since low income housing is a regional problem. <br /> <br />On a motion by Mr. Conover, seconded by Dr. Hall, the Housing <br />Assistance Plan was unanimously approved by Council with the modifications <br /> <br />suggested by Mr. Conover. <br /> <br /> On a motion by Dr. Hall, seconded by Dr. Gunter, the Council unani- <br />mously approved the following resolution authorizing the Mayor to sign a <br />deed with restrictive covenants for 609 Brown Street: <br /> <br /> WHEREAS, the City of Charlottesville is owner of certain real estate. <br />fronting on Brown Street in the City of Charlottesville, Virginia, more <br />par. ticularly described as Parcel 129 on City Real Property Tax Map 32, <br />with 99 feet of frontage on Brown Street and having a depth of 60 feet, <br />conveyed to the City by deed recorded in the Clerk's Office of the Circuit <br />Court of the City of Charlottesville in Deed Book 427, page 427, and a <br />portion of Parcel 20, on City Real Property Tax Map 32, with 135 feet <br />of frontage on Brown Street and having a depth of 60 feet; and <br /> <br /> WHEREAS, the City Council recognizes the concerns of adjacent <br />property owners as to the impact of certain permitted uses in M-1 <br />Restricted Industrial zones; and <br /> <br /> WHEREAS, the City Council recognizes the need for assurance to the <br />adjacent property owners that the City will not use the said property for <br />activities which have a significant adverse impact on the adjacent <br />property owners and neighborhood; and <br /> <br /> WHEREAS, the City Council recognizes the need for a visual buffer <br />between the City Yard uses on the said property and the residential <br />area to the south; and <br /> <br /> WHEREAS, the City Council is willing and wants to restrict the use <br />of said property; <br /> <br />WITNESSETH: <br /> <br /> Therefore, in consideration of the benefits to be de~i'v~d by the <br />City and adjacent owners from such restrictions, the City Council does <br />hereby voluntarily agree to restrict the use of the aforesaid property <br />as follows: <br /> <br />(1) The above mentioned property shall only be used for <br /> parking, storage of non-hazardous materials and equipment, <br /> offices or residential uses. <br /> <br />(2) The City shall cause evergreen screening to be along the <br /> street frontages of theproperty to act as a visual and <br /> aesthetic buffer from adjacent residences. <br /> <br />(3) The height of any building erected on the property shall <br /> not exceed 45 feet. <br /> <br /> These restrictions are such that they run with the land and are <br />binding on the present owners and all successors. They are granted for <br />the benefit of the City of CHarlottesville, the Starr Hill Neighborhood <br />Association or its successors or assigns, and the adjacent property <br />owners or their successors or assigns, any of whom may seek to enforce <br />this covenant, at their discretion, in a court of appropriate equity <br />jurisdiction. <br /> <br />On a motion by Mrs. Gleason, seconded by Dr. Gunter, the following <br /> <br />resolution was unanimously adopted by Council: <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that the gates to the City Yard located on Brown Street will <br /> <br /> <br />
